AFTER proper posting of public notice, a copy of which is attached hereto, on
this the 24th day of September, 2001, the County Commissioners Court of Bell County, Texas,
met in the Commissioners' Courtroom in Belton, Texas, in regular special session with the
following members of said Court present, to-wit:

Agenda #1 - Minutes
MINUTE ORDER #305/01: It being nine
a.m. JUDGE
BURROWS called the meeting to order and called to the Courts
attention the fact that they had previously received copies of the minutes
of September17, 2001. He asked if there were any corrections
or additions to the minutes; there being none, the minutes were
approved as submitted.
Agenda #2a - Schwald Road Closure
- MINUTE ORDER #306/01: JUDGE BURROWS
announced that the public hearing was open to discuss the
vacation/abandonment of Schwald Road from 60th Street in Killeen to the
west. He asked if there was any public comment and Ms. Jean
Gawryszewski appeared before the Court to discuss various matters
appertaining to such closure; one being "would it increase anyone
taxes if they chose to take the road into their property." It
was explained that if you did not want the road you did not have to take
it. If the County closed the road, the only thing they would do is
to Quit claim any right, title, or interest in the road. There being
no further comments, the public hearing was closed and thereafter, upon
motion of COMMISSIONER CORTESE, seconded
by COMMISSIONER STEPHENSON, the Court unanimously
authorized the abandonment of such road and authorized the County Judge to
execute a Quit Claim Deed to such road on behalf of Bell County.
Agenda #2b - Authority to Bid for Track Loader and
Motor Graders
- MINUTE ORDER #307/01: The County Engineer presented
the matter of advertising for bids for equipment that is budgeted in the
2002 budget. Funding for the four motor graders to come from the
general fund in the amount of approximately #161,000, after exercising the
buy-back provision option and the track loader to come from the bridge
maintenance fund in the approximate amount of $220,000.00. After due discussion,
upon motion of COMMISSIONER BROWN seconded by, COMMISSIONER
CORTESE, the
Court unanimously approved such request and authorized such bidding.
- Agenda #2c - Personnel
- MINUTE ORDER #308/01: Upon motion of COMMISSIONER
SCHILLER, seconded by COMMISSIONER STEPHENSON, the
Court unanimously approved all employee status report forms, the same
being attached hereto and made a part of these minutes.
- Agenda #3 - Internet/Computer Usage Policy
- MINUTE ORDER #309/01: Mr. Ron Heuss, Director,
Human Resources Department appeared before the Court to present an
internet/computer usage policy for Bell County Employees. After due
discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER
STEPHENSON, the Court
unanimously approved such policy and ordered the same effective October 1,
2001. All according to a copy of the same attached hereto and made a
part of these minutes for all purposes.
- Agenda #4 - H.E.L.P. Center Lease
- MINUTE ORDER #310/01: Representative of the H.E.L.P.
appeared before the Court to discuss the Family Assistance Team (FAT) for
a mobil unit of the Bell County H.E.L.P. Center for Fort Hood (A fact
sheet being attached hereto). JUDGE BURROWS then
presented the matter of a lease for the H.E.L.P. in Temple. After
due discussion, upon
motion of COMMISSIONER SCHILLER, seconded by
COMMISSIONER STEPHENSON, the Court
unanimously approved authorizing JUDGE BURROWS to execute
such lease on behalf of Bell County and authorized him to further
negotiate with the City of Temple for a renewal option on such
lease. All according to a copy of the same attached hereto.
- Agenda #5 - B.A.I.T. Grant
- MINUTE ORDER #311/01: Sheriff Dan Smith, and Mr. Don
Engleking, Coordinator of the BAIT Grant Program appeared before the Court
requesting the continuation of such Grant and authorizing other Cities to
participate in such program. After due discussion, upon
motion of COMMISSIONER CORTESE, seconded by
COMMISSIONER SCHILLER, the Court
unanimously authorized JUDGE BURROWS to execute such grant
on behalf of Bell County and to execute interlocal agreements with other
cities for participation in such Grant. .
- Agenda #6 - Right of way Acquisition for Joint Use Airport
- MINUTE ORDER #312/01: JUDGE BURROWS presented
the matter of funding by Bell County of the Right-of-Way acquisition for
the joint use airport and after all due discussion, upon motion of COMMISSIONER
BROWN, seconded by COMMISSIONER STEPHENSON, the
Court unanimously authorized the dedication of one million dollars from
the County's recently issued Certificates of Obligation for the purpose of
acquiring such right of way and authorized JUDGE BURROWS to
negotiate with the City of Killeen on the final acceptance of such funds.
- Agenda #7 - Redistricting Plan for Submission to the Department of
Justice
- MINUTE ORDER #313/01: JUDGE BURROWS presented
the redistricting plans purposed by the Redistricting Committee. The
two plans having obtained the most agreement of the Redistricting
Committee being the Melton Plan and the plan number 5-C-2 (Brown)
plan. He discussed the purposed change in the Commissioners Precinct
Lines and the purposed change in the Justice Court Lines. After due
discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER
SCHILLER, the Court with COMMISSIONER STEPHENSON voting
'NO,' and JUDGE BURROWS and COMMISSIONER CORTESE voting
'YES' the Court approved the concept of plan number 5-C-2 (Brown) and
authorized preceding with the necessary submissions to the Justice
Department with the aforementioned plan.
- Agenda #8 - District Attorney's Audit Report of Forfeiture Funds
- MINUTE ORDER #314/01: County Auditor, Donna Eakin,
presented the District Attorney's annual audit report for funds received
for forfeiture by the State's Attorney for the past year and the
expenditures from the same. After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER
CORTESE, the Court with unanimously approved such report and
ordered the same forwarded to the Attorney General's Office as authorized
by law.
- Agenda #9 - Phone Line Request
- MINUTE ORDER #315/01: The Court considered the
request of Justice of the Peace Don Svadlenak with respect to an
additional phone line for fax and LAN connections and after due
discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER
CORTESE, the Court with unanimously approved such request, the
same being attached hereto.
- Agenda #10 - Claims
- MINUTE ORDER #232/01: The County Auditor presented
all claims for the review of the Court. After proper review, upon
motion of COMMISSIONER BROWN, seconded by COMMISSIONER
CORTESE, the Court unanimously approved all such claims.
All according to a copy of the same on record in the office of the
County Auditor.
(The Court then went into workshop session in the Conference room and the
following items of
business were discussed and no action taken on the same, to-wit: 1)
Report on status on plans
education building at juvenile center; 2) Building maintenance and
security issues; and
3) Redistricting.
There being no further business, the meeting was adjourned.
