AFTER proper posting of public notice, a copy of which is attached hereto, on this the 9th day of October, 2001, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular special session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #328/01:  It being nine a.m. JUDGE BURROWS called the meeting to order and called to the Courts attention the fact that they had previously received copies of the minutes of October 1, 2001.  He asked if there were any corrections or additions to the minutes;  there being none, the minutes were approved as submitted.   



  2. Agenda #2a - Detention Pond for Road and Bridge Department

    • MINUTE ORDER #329/01:  The County Engineer presented the matter of authorizing the County Judge to sign a contract with Roming, Parker & Kasberg, LLP, for the design of detention ponds for the Bell County Road and Bridge Yard in Belton. Such contract would call for the expenditure of some $6800.00.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER SCHILLER, the Court unanimously approved authorizing the County Judge to execute the aforementioned contract on behalf of Bell County and authorized the expenditure of such funds, all according to a copy of such contract attached hereto and made a part of these minutes for all purposes.     



  3. Agenda #2b - Contract with CBS Environmental, Inc.

    • MINUTE ORDER #330/01:  The matter of a contract with CBS Environmental, Inc for the preparation of required documents for the Texas Pollution Discharge Elimination System Permit for the Road and Bridge Yard was tabled pending further study.          



  4. Agenda #2c - Berry Road Subdivision

    • MINUTE ORDER #331/01:  The County Engineer presented the matter of the final plat for Berry Road Subdivision.  He reported that the City of Temple has reviewed and approved such plat; the developer has consented to dedicating an additional five feet of right of way on Berry Road;  and the Moffat Water Supply has provided a letter with respect to the availability of water to the subdivision.  The County Engineer recommended the approval of such plat.  After due discussion, upon motion of COMMISSIONER SCHILLER seconded by,  COMMISSIONER STEPHENSON, the Court unanimously approved the final plat of the Berry Road Subdivision and ordered the same filed for record.          



  5. Agenda #2d - Personnel

    • MINUTE ORDER #332/01:  Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER STEPHENSON, the Court unanimously approved all employee status report forms save and except the increase in pay for part time positions, one in the District Clerk's Office and one in the Sheriff's Office.  All according to a copy of the same attached hereto and made a part of these minutes.         



  6. Agenda #3 - New FCS Agent

    • MINUTE ORDER #333/01:  Representatives from the County Extension Service appeared before the Court to introduce the new Family and Consumer Scient Agent, LINDA FUCH to the Court.  Ms. Fuch will be replacing previous agent Ilene Miller effective November 1, 2001.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved such employment.            



  7. Agenda #6 - Interlocal Cooperation Act Contract

    • MINUTE ORDER #334/01:  District Attorney Henry Garza appeared before the Court to discuss the proposed Interlocal Cooperation Act Contract between the Office of the Attorney General of Texas and the District Attorney for Bell County.  Mr. Garza explained that the program was designed to add an attorney for the purpose of prosecuting repeat offenders who used firearms in the commission of crimes.  He explained that Bell County would not have to bear any of the cost of such prosecutor who would be housed in the Waco Federal Prosecutor Office, but could be called upon to prosecute cases in the Western Federal District Court.  After due discussion, upon motion of COMMISSIONER SCHILLER, seconded by COMMISSIONER STEPHENSON, the Court unanimously approved authorizing Mr. Garza to execute the contract on behalf of Bell County.  All according to a copy of the same attached hereto and made a part of these minutes.        



  8. Agenda #4 - "Breakout Bailbond" Foreclosure

    • MINUTE ORDER #335/01:  The matter of authorizing foreclosure of property held in trust by Bell County for the purpose of writing Bail Bonds for "Breakout Bailbond," and authorizing the employment of an Attorney to take the proper legal actions was discussed and after due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER STEPHENSON, the Court unanimously authorized the employment of the Honorable Neil Potts, Attorney-at-Law, Belton, Texas, to foreclose on Lot S 60.47' of No 140' of 1 Blk, Original Town of Belton described in a deed from Frank Sefcik, et ux, to Eddie Llwelling, et ux and recorded in Vol. 1327, page 67, Deed Records of Bell County, Texas.  Such property having previously been deeded to Bell County in Trust for the purpose of writing bail bonds by the "Breakout Bailbond" Company, by licensee Charles Ferris, and the same having defaulted on the payment of such bond forfeitures.          



  9. Agenda #7 - Disbursement of Child Safety Funds

    • MINUTE ORDER #336/01:  The Court discussed with Sharon Long, Tax Assessor-Collector, the disbursement of funds collected by her Office for the purpose of Child Safety and upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved such disbursements as suggested by Ms. Long to the allocation to the Village of Salado and those funds would be calculated on the incorporation figures gathered at the time of the incorporation.  All according to a copy of such report attached hereto and made a part of these minutes.           



  10. Agenda #8 - Claims

    • MINUTE ORDER #337/01:  The County Auditor presented all claims for the review of the Court.  After proper review, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved all such claims.  All according to a copy of the same being of record in the office of the County Auditor.


                    (The Court removed to the Conference room to lay out maps with respect to redistricting and
                    with all members present, the following transpired.)



  11. Agenda #5 - Redistricting

    • MINUTE ORDER #338/01:  The Court then discussed a resolution in compliance with Section 5 of the Voting Rights Act of 1965, as Amended, and specifically a resolution pertaining to Redistricting of the Commissioners Precincts, the Justice of the Peace and Constable Precincts, and changes to the Election Precincts and Polling Places and after due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved such resolution and the attached maps.  All according to a copy of such resolution attached hereto and made a part of these minutes for all purposes. 


                (The Court then adjourned its regular meeting and went in to Workshop Session to discuss the 
                items listed on the agenda attached hereto with no action being taken on any item.)
