AFTER proper posting of public notice, a copy of which is attached hereto, on this the 27th day of October, A.D. 2003, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #437/03:  It being nine a.m., JUDGE BURROWS called the meeting to order and called to the Courts attention the fact that they had previously received copies of the minutes of October 14, 2003.  He asked if there were any corrections or additions, there being no corrections, the minutes were approved as submitted.  The presentation of the minutes of October 20, 2003, was waived at the present time.        



  2. Agenda #4 - Certification of Appreciation to Virginia Denman

    • MINUTE ORDER #438/03:  Sheriff Dan Smith presented a certificate of appreciation to Virginia Denman for her assistance in the arrest of two individuals attempting to burglarize a place of business.     



  3. Agenda #2a - Public Hearing for the Abandonment of Deer Park Road

    • MINUTE ORDER #439/03:  JUDGE BURROWS opened a public hearing regarding the abandonment/vacation of Deer Park Road from Riverside Drive to the Lampasas River in Triple Seven Estates Subdivision.  Mr. Mitch Connell reported that this road created a law enforcement problem in the area plus being a trash dump and that he would like to see the road closed.  There being no further public comment, JUDGE BURROWS closed the public hearing and after due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER SCHILLER, the Court unanimously approved the abandonment/vacating of such road, all according to a copy of a map attached hereto and made a part of these minutes.        


  4. Agenda #2b - Public Hearing on Traffic Control Devices

    • MINUTE ORDER #440/03:  JUDGE BURROWS opened the public hearing to consider the installation of the following traffic devices, to-wit:  1) Install a stop sign on Bell Meadows Blvd at Campbell Hill Road;  2) Install a yield sign on Cartwright Loop at FM 439 (2 locations);  3) Install 45 mph speed limit on Turkey Trot Road;  and 4) Install 45 mph speed limit on Kuykendall Branch Road from Grainger Road to 1.25 miles north.  He asked if there were any public comments.  There being none, the public hearing was closed.  Thereafter, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER FISHER, the Court unanimously approved the installation of all such traffic control devices.        



  5. Agenda #2c - Authority to Advertise for bids for Sale of 4 Motor Graders

    • MINUTE ORDER #441/03:  Upon motion of COMMISSIONER SCHILLER, seconded by COMMISSIONER CORTESE, the Court unanimously authorized advertising for bids for the sale of four 140H Caterpillar motor graders.       



  6. Agenda #3 - Personnel

    • MINUTE ORDER #442/03:  Upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved all employee status report forms, the same being attached hereto and made a part of these minutes.       



  7. Agenda #5 - Report of Bell County Child Welfare Board

    • MINUTE ORDER #443/03:  Chairman of the Child Welfare Board, Barbara Keetch, appeared before the Court to give a report of the activities of the Bell County Child Welfare Board.  The same being attached hereto and made a part of these minutes.        



  8. Agenda #6 - Columns at the Law Enforcement Center

    • MINUTE ORDER #444/03:  Upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved rejecting the bid on repairs and maintenance of the columns at the Law Enforcement Center and readvertising for bids for the same.       



  9. Agenda #7 - Sale and Removal of County Property at 120 North Blair in  Belton

    • MINUTE ORDER #445/03:  Assistant County Auditor Russell Williams reported that no bids had been received for unneeded County Property at 120 North Blair in Belton, the same being a house.  After due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER BROWN, the Court authorized rebidding for such removal of the house at 120 North Blair.      



  10. Agenda #8 - Sale of County 10 Phone System

    • MINUTE ORDER #446/03:  Assistant County Auditor Russell Williams reported to the Court that a portion of the County's old phone system had been sold, but a portion of the items remained.  He asked for permission to attempt to sell the remaining items on the Internet.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER SCHILLER, the Court unanimously approved the sale of a portion of the County's old phone system and authorized the sale of the remaining items on the Internet.        



  11. Agenda #9 - Old Precinct #4 Property Improvements

    • MINUTE ORDER #447/03:  Upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER FISHER, the Court unanimously authorized the Hill Country Transit District to construct improvements on the Old Precinct #4 Maintenance Property on FM 2410 in Killeen, all according to a copy of such agreement attached hereto.        



  12. Agenda #10 - Interlocal Agreement with the City of Temple

    • MINUTE ORDER #448/03:  Upon motion of COMMISSIONER SCHILLER, seconded by COMMISSIONER CORTESE, the Court unanimously approved authorizing JUDGE BURROWS, to execute an Interlocal Agreement with the City of Temple for the use of the County's Early Voting System.  All according to a copy of the same attached hereto and made a part of these minutes.       



  13. Agenda #11 - Resolution Concerning Highway Projects

    • MINUTE ORDER #449/03:  Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved a resolution in support of improvements to FM 439 and SH 36 under Mobility 2030 Plan for State Highway Projects.  The same being attached hereto and made a part of these minutes.       



  14. Agenda #12 - Inter-Jurisdictional Mutual Aid Agreement

    • MINUTE ORDER #450/03:  Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER SCHILLER, the Court unanimously authorized the County Judge to execute an Inter-Jurisdictional Mutual Aid Agreement with the cities of Bartlett, Holland, Killeen, Little River, Morgan's Point Resort, Nolanville, Rogers, Village of Salado, Temple, and Troy to furnish mutual aid during disasters  and/or civil emergencies.  (Agreements have already been approved for the cities of Belton and Harker Heights.)       



  15. Agenda #13 - Claims

    • MINUTE ORDER #451/03:  The County Auditor presented all claims for the review of the Court.  Upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved all such claims.  All according to a copy of the same on record in the office of the County Auditor.  


      (The Court then went into executive session to discuss personnel matters and real estate matters and thereafter, went into workshop session to discuss those items on the workshop agenda with no action being taken on the same.)



              There being no further business, the meeting was adjourned.
