AFTER proper posting of public notice, a copy of which is attached hereto, on this the 12th day of January, A.D. 2004, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #006/04:  It being nine a.m. JUDGE BURROWS called the meeting to order and called to the Courts attention the fact that they had previously received copies of the minutes of January 5, 2004.  He asked if there were any corrections or additions, there being no corrections, the minutes were approved as submitted.          



  2. Agenda #2 - Burn Ban

    • MINUTE ORDER #007/04:  Mr. Steve Casey, County Fire Marshal, presented the matter of a burn ban for Bell County.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER SCHILLER, the Court unanimously approved a 30 day burn ban for Bell County beginning at 7 p.m. today with the understanding that if Bell County received enough rain that the ban may be lifted by the County Judge.              



  3. Agenda #3a - Public Hearing Concerning Closing of Neroc Road

    • MINUTE ORDER #008/04:  JUDGE BURROWS opened the public hearing on the issue of the closing of the Neroc Road over the B.N. & S.R. Railroad Tracks in Rogers, Texas.  The following individuals spoke concerning the issue, to-wit:  Diane Cates, Rogers City Administrator; Tim Huya, Railroad Representative; Della Lashbrook, Rogers City Council Person; Alfred Taylor, Rogers Resident; Jerald McLean, Rogers Resident; Gene Ring, Rogers Resident; Clint Ralston, Rogers Resident; Don McCurdy, Rogers Resident; Kevin Merts, Rogers City Police Chief; and Harvey Kelley, Rogers Fire Chief.  There being no further comment, the Public Hearing was closed.  By consensus, the Court took no action on this item pending further study.             



  4. Agenda #3b - Interlocal Agreement with City of Belton

    • MINUTE ORDER #009/04:  The County Engineer presented the matter of an Interlocal Agreement with the City of Belton to prime the walkway/trail in the Quail Meadows Community Park Project.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER FISHER, the Court unanimously authorized the County Judge to execute such Interlocal Agreement with the City of Belton on behalf of Bell County.               



  5. Agenda #3c - Authority to Bid for Road and  Bridge Materials

    • MINUTE ORDER #010/04:  Upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved authorizing the County Engineer to advertise for bids for the purchase of liquid asphalt, cold mix, hot mix, and pit-run gravel and concrete for the Road and Bridge Department materials.              



  6. Agenda #4 - Personnel

    • MINUTE ORDER #011/04:  Ms. Stephanie Turnham, Museum Director, appeared before the Court to give the Bell County Museum's annual report and to present the recommended Board of Trustees for the Museum.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER FISHER, the Court unanimously approved the employee status report forms and the members of the Board of Trustees for the Bell County Museum, all according to a copy of the same attached hereto and made a part of these minutes.  



  7. Agenda #5 - Interlocal Agreement with Kerr County for MH/MR Services

    • MINUTE ORDER #012/04:  The County Judge presented for approval by the Court, the Interlocal Agreement with Kerr County for Mental Health/Mental Retardation, Chemical Dependency Commitment Hearings, and Psychoactive Medication Hearings at Kerrville State Hospital.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER SCHILLER, the Court unanimously approved authorizing JUDGE BURROWS to execute such Interlocal Agreement on behalf of Bell County.  All according to a copy of the same attached hereto and made a part of these minutes.  



  8. Agenda #6 - Working Agreement with Lone Star Legal Aid

    • MINUTE ORDER #013/04:  JUDGE BURROWS presented the Rapid Response System Cooperative Working Agreement with Lone Star Legal Aid in support of a Violence Against Women Act continuation grant from the Criminal Justice Division of the Governor's Office.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER SCHILLER, the Court unanimously approved such working agreement with the Lone Star Legal Aid in support of their continuation grant concerning Violence Against Women Act.  All according to a copy of such agreement attached hereto and made a part of these minutes.               



  9. Agenda #7 - 15 Main, LTD Tax Abatement Agreement

    • MINUTE ORDER #014/04:  (Judge Burrows recused himself with respect to this matter because of previous business relationship with the Applicant for such Abatement Agreement).  The Court discussed the adoption of a tax abatement agreement with property located at 15 North Main Street in Temple, Texas by 15 Main, Ltd.  After due discussion, upon motion of COMMISSIONER SCHILLER, seconded by COMMISSIONER CORTESE, the Court, with COMMISSIONER BROWN voting "NO", the Court approved such Tax Abatement Agreement.  A copy of the same being attached hereto and made a part of these minutes.               



  10. Agenda #8 - Agreement with First Southwest Asset Management, Inc.

    • MINUTE ORDER #015/04:  JUDGE BURROWS presented the agreement with First Southwest Asset Management, Inc. For Arbitrage Rebate Compliance Services.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved such agreement, all according to a copy of the same being attached hereto and made a part of these minutes.               



  11. Agenda #9 - Budget Amendment

    • MINUTE ORDER #016/04:  The County Auditor presented the matter of a budget amendment for the cost of repairs and rehabilitation of columns at the Bell County Jail.  After due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER SCHILLER, the Court unanimously approved such budget amendment.  All according to a copy of the same attached hereto and made a part of these minutes.               



  12. Agenda #10 - Claims

    • MINUTE ORDER #017/04:  The County Auditor presented all claims for the review of the Court.  Upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved all such claims.  All according to a copy of the same on record in the office of the County Auditor. 


      (The Court then went into workshop session to discuss those items on the workshop agenda with no action being taken on the same.)



              There being no further business, the meeting was adjourned.
