AFTER proper posting of public notice, a copy of which is attached hereto, on this the 27th day of September, A.D. 2004, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #320/04:  It being nine a.m. JUDGE BURROWS called the meeting to order and called to the Courts attention the fact that they had previously received copies of the minutes of September 13, 2004.  He asked if there were any corrections or additions to the minutes; there being no corrections, the minutes were approved as presented.              


  2. Agenda #2a - Blassingame Subdivision

    • MINUTE ORDER #321/04:  Upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER SCHILLER, the Court unanimously approved the final plat of Blassingame Subdivision and ordered the same filed for record. 



  3. Agenda #2b - Preliminary Plat of Walnut Creek Estates Phase VI

    • MINUTE ORDER #322/04:  The matter of the preliminary plat for Walnut Creek Estates Phase VI subdivision and upon the recommendation of the County Engineer, on motion of COMMISSIONER FISHER, seconded by COMMISSIONER CORTESE, the Court unanimously approved the same.      



  4. Agenda #2c - Authorized Bidding for Road and Bridge Department Materials

    • MINUTE ORDER #323/04:  Upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER CORTESE, the Court unanimously approved authorizing the County Engineer to advertise for bids for culvert pipes, crushed limestone base, and reinforcing steel. 



  5. Agenda #3 - Personnel

    • MINUTE ORDER #324/04:  Upon motion of COMMISSIONER SCHILLER, seconded by COMMISSIONER CORTESE, the Court unanimously approved all employee status report forms, the same being attached hereto and made a part of these minutes. 



  6. Agenda #4 - Burn Ban

    • MINUTE ORDER #325/04:  The Court discussed with the Fire Marshal the instigation of a burn ban in Bell County and after due discussion, upon motion of COMMISSIONER CORTESE, the Court unanimously approved the implementing of such ban effective Thursday, September 30, at 7 p.m. for 30 days with the further understanding that the County Judge have the authority to lift such ban if sufficient rain is received.  All according to such order attached hereto and made a part of these minutes.



  7. Agenda #5 - Interlocal Agreement with City of Copperas Cove

    • MINUTE ORDER #326/04:  Upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER BROWN, the Court unanimously approved authorizing the County Judge to execute an Interlocal Agreement between Bell County and the City of Copperas Cove supporting interoperability of each entity's 800 MHZ trunked radio system.    



  8. Agenda #6 - Resolution concerning HAVA Grant Award Agreement

    • MINUTE ORDER #327/04:  JUDGE BURROWS presented the matter of a resolution approving the Help American Vote Act (HAVA) grant award agreement with the Office of the Secretary of State of the State of Texas regarding funding allocations of reimbursements up to $9,000.00 for County Education Fund for professional election training for county election officials;  up to $129,000.00 for handicapped accessible voting systems in each polling place; and up to $224,814.75 for general HAVA compliance such as replacement of Bell County's lever voting machines. 



  9. Agenda #7 - Common Integrated Justice System TechShare Project Addendum - Phase III

    • MINUTE ORDER #328/04:  Upon motion of COMMISSIONER SCHILLER, seconded by COMMISSIONER BROWN, the Court unanimously approved authorizing JUDGE BURROWS to execute the revised Common Integrated Justice System (CIJS) TechShare Project Addendum - Phase III to the Master Interlocal Agreement with the Texas Conference of Urban Counties. 



  10. Agenda #8 - Utility Installation Agreement

    • MINUTE ORDER #329/04:  Upon motion of COMMISSIONER SCHILLER, seconded by COMMISSIONER BROWN, the Court unanimously approved a Utility Installation Agreement between Valor Telecom and Bell County regarding boring under the road to the west side starting at 9693 Hunt Hill Road in the Rogers Exchange.     



  11. Agenda #9 - Bell County's Investment Policy

    • MINUTE ORDER #330/04:  Upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER CORTESE, the Court unanimously approved the investment policy of Bell County, the same being attached hereto and made a part of these minutes. 



  12. Agenda #10 - Annual Audit of the District Attorney's Forfeiture Report

    • MINUTE ORDER #331/04:  Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER FISHER, the Court unanimously approved the annual audit of the District Attorney's Forfeiture Report as presented by the County Auditor, the same being attached hereto. 



  13. Agenda #11 - Sheriff and Constables' Fees

    • MINUTE ORDER #332/04:  Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER FISHER, the Court unanimously approved the 2005 Sheriff's fees and Constables' fees and other fees, the same being attached hereto and made a part of these minutes. 



  14. Agenda #12 - Addition Justice Court Technology Fees

    • MINUTE ORDER #333/04:  Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER FISHER, the Court unanimously approved raising the Justice Court technology fee from $2.00 to $4.00 effective October 1, 2004.     



  15. Agenda #13 - 2005 Holidays

    • MINUTE ORDER #334/04:  Upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER CORTESE, the Court unanimously approved holidays for the year 2005, the same being attached hereto and made a part of these minutes.      



  16. Agenda #14 - County Representative to the Solid Waste Advisory Committee

    • MINUTE ORDER #335/04:  Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER FISHER, the Court unanimously approved appointing County Engineer Macchi to the Solid Waste Advisory Committee of the Central Texas Council of Government.      



  17. Agenda #15 - Appointment to Board of Trustees for Central Counties MHMR Center

    • MINUTE ORDER #336/04:  Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER FISHER, the Court unanimously approved the ratification of Coryell County's appointment of Ms. Gwen Ziegler for a two-year term on the Board of Trustees for Central Counties MHMR Center.    



  18. Agenda #16 - Proclamation concerning "Lawsuit Abuse Awareness Week"

    • MINUTE ORDER #337/04:  Upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER CORTESE, the Court unanimously approved proclaiming October 4-8, 2004 as "Lawsuit Abuse Awareness Week."     



  19. Agenda #17 - "Czech Heritage Month"

    • MINUTE ORDER #338/04:  Upon motion of COMMISSIONER SCHILLER, seconded by COMMISSIONER CORTESE, the Court unanimously approved declaring the month of October as "Czech Heritage Month" in Bell County, Texas.    



  20. Agenda #18 - Claims

    • MINUTE ORDER #339/04:  The County Auditor presented all claims for the review of the Court.  After proper review, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved all such claims.  All according to a copy of the same being of record in the office of the County Auditor. 


      (The Court then went into workshop session to discuss those items on the workshop agenda with no action being taken on any item.) 


              There being no further business, the meeting adjourned.
