AFTER proper posting of public notice, a copy of which is attached hereto, on this the 1st day of November, 2004, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #391/04:  It being nine a.m. JUDGE BURROWS called the meeting to order and called to the Courts attention the fact that copies of the minutes of October 18, 25, & 29, 2004 were not ready for review and the approval of the minutes were waived to be considered for approval at a later Court session.  



  2. Agenda #2a - Plat for Mill Creek Springs Overlook, Phase 2

    • MINUTE ORDER #392/04:  The County Engineer presented the matter of final approval of the Plat for Mill Creek Springs Overlook, Phase Two, being a replat of Mill Creek Springs Overlook, a 6-Lot, 7.41 acre development in the E.T.J. of the Village of Salado and recommended approval, pointing out it had been approved by the Village of Salado.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER SCHILLER, the Court unanimously approved such plat and ordered the same filed of record. 


  3. Agenda #2b - Denial of Preliminary Approval of Ryan Addition

    • MINUTE ORDER #393/04:  The County Engineer presented the matter of the denial of the preliminary approval of Ryan Addition.  The court had approved the Preliminary Plat on August 26, 2002, and then approved a sixty (60) day extension on August 23, 2004, which expired on October 25, 2004 without a request for approval of a final plat or for an extension of time of the preliminary plat.  The County Engineer recommended the denial of the preliminary approval of Ryan Addition.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER FISHER, the Court unanimously approved the denial of the preliminary approval of the plat of Ryan Addition.  


  4. Agenda #2c - Variance to Subdivision Platting for two 5.006 acre tracts on Elmer King Road

    • MINUTE ORDER #394/04:  The County Engineer presented the matter of granting variance to subdivision platting for two 5.006 acre tracts of Elmer King Road.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved such variance. 


  5. Agenda #3 - Personnel

    • MINUTE ORDER #395/04:  Upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER CORTESE, the Court unanimously approved all employee status report forms, the same being attached hereto and made a part of these minutes. 



  6. Agenda #4 - MOU between Bell County and the Board of Trustees of the Killeen Independent School District

    • MINUTE ORDER #396/04:  Tom Kozeny of the Juvenile Probation Department presented for the approval of the Court the Memorandum of Understanding between Bell County and the Board of Trustees of the Killeen Independent School District regarding educational services at the Bell County Juvenile Detention Center and after due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER CORTESE, the Court unanimously approved such Memorandum of Understanding attached hereto and made a part of these minutes.  



  7. Agenda #5 - Authorizing County Auditor to Advertise for bids for vehicles for the Building and Grounds Department and the Road and Bridge Department

    • MINUTE ORDER #397/04:  Russell Williams of the County Auditor's office presented requests to advertise for bids for one 3/4 ton pickup and one van for the Building and Grounds Department, and one 3/4 ton pickup and four 1 ton pickups for the Road and Bridge Department, and after due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER CORTESE, the Court unanimously approved such requests and authorized the County Auditor to advertise for bids, with the cost of such vehicles to be paid out of the current Fiscal Year Budget or future financing.  



  8. Agenda #6 - Authorizing County Auditor to Advertise for bids for a General Contractor for the Bell County Museum Projects

    • MINUTE ORDER #398/04:  Stephanie Turnham of the Bell County Museum and Russell Williams of the County Auditor's office presented requests to advertise for bids for a General Contractor for the Bell County Museum Projects and to request bid on both the initial plans and the revised plans, and after due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER FISHER, the Court unanimously approved such requests and authorized the County Auditor to advertise for bids for a General Contractor for the Bell County Museum Projects for both the initial plans and the revised plans.   



  9. Agenda #7 - Membership in the Cooperative Purchasing Network (TCPN)

    • MINUTE ORDER #399/04:  Russell Williams of the County Auditor's office presented for approval an Interlocal Agreement for Bell County to become a member of The Cooperative Purchasing Network (TCPN) as authorized in Section 271.101 and 271.102 of the Local Government Code allowing Bell County to take advantage of cooperative purchasing efforts, and recommended its approval, and after due discussion, upon motion of COMMISSIONER SCHILLER, seconded by COMMISSIONER CORTESE, the Court unanimously approved such Interlocal Agreement attached hereto and made a part of these minutes. 



  10. Agenda #8 - Interlocal Agreement with the City of Temple

    • MINUTE ORDER #400/04:  Sharon Long, Tax Assessor-Collector, presented for approval an Interlocal Agreement allowing the City of Temple to use Bell County's computer software and fiber optic network to process and maintain records regarding early voting in City of Temple elections, and after due discussion, upon motion of COMMISSIONER SCHILLER, seconded by COMMISSIONER CORTESE, the Court unanimously approved such Interlocal Agreement attached hereto and made a part of these minutes.


  11. Agenda #9 - Public Sale by the Tax Appraisal District of Lot 5, Block 2, Carver Addition to the City of Temple

    • MINUTE ORDER #401/04:  The matter of approval of a Resolution Requesting a Public sale of Property Acquired by the Tax Appraisal District of Bell County at a Delinquent Tax sale, namely Lot 5, Block 2, Carver Addition to the City of Temple, Bell County, Texas, pursuant to Section 34 of the Texas Tax Code was presented, and after due discussion, upon motion of COMMISSIONER SCHILLER, seconded by COMMISSIONER CORTESE, the Court unanimously approved such Resolution attached hereto and made a part of these minutes. 



  12. Agenda #10 - Reimbursement Resolution Regarding the Reimbursement of Certain Expenses from the Proceeds of Tax Exempt Obligations

    • MINUTE ORDER #402/04:  The matter of approval of a Reimbursement Resolution of the Commissioners Court of Bell County, Texas, Regarding the Reimbursement of Certain Expenses from the Proceeds of Tax Exempt Obligations was presented, and after due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER  BROWN, the Court unanimously approved such Resolution attached hereto and made a part of these minutes. 



  13. Agenda #11 - Claims

    • MINUTE ORDER #403/04:  The County Auditor presented all claims for the review of the Court.  After proper review, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved all such claims.  All according to a copy of the same being of record in the office of the County Auditor. 


      (The Court then went into workshop session to discuss those items on the workshop agenda with no action being taken on any item.) 


              There being no further business, the meeting adjourned.
