met in the Commissioners' Courtroom in Belton, Texas, in regular session with the

Agenda #1 - Minutes
- MINUTE ORDER #454/04: It being nine a.m. JUDGE
BURROWS called the meeting to order and called to the Courts
attention the fact that they had previously received copies of the minutes
of December 6, 2004. He asked if there were any corrections or
additions to the minutes; there
being no corrections, the minutes were approved as submitted.
Agenda #2a - Kilpatrick Addition, Phase II
Subdivision
- MINUTE ORDER #455/04: The County Engineer presented
the matter of the final approval of Kilpatrick Addition, Phase II
Subdivision. After due discussion, upon motion of COMMISSIONER
BROWN, seconded by COMMISSIONER FISHER, the Court
unanimously approved such subdivision plat and ordered the same filed for
record.
Agenda #2b - S & M Addition Subdivision
- MINUTE ORDER #456/04: Upon motion of COMMISSIONER
BROWN, seconded by COMMISSIONER SCHILLER, the Court
unanimously approved tabling the matter of the final approval of S & M
Addition Subdivision.
Agenda #2c - Recinding Minute Order #215/04 dated
July 6, 2004 (Hoelscher Estates)
- MINUTE ORDER #457/04: The County Engineer presented
the matter of rescinding the Court's action taken on July 6, 2004 in
Minute Order #215/04. He explained that the developer no longer
desires to develop the property and intends to sell it off to three
adjacent landowners in large tracts. He further explained that the
plat nor the dedication were ever recorded with the County Clerk's
Office. After due discussion, upon motion of COMMISSIONER
SCHILLER, seconded by COMMISSIONER CORTESE, the Court
unanimously approved the rescinding of Minute Order #215/04, approved on
July 6, 2004.
Agenda #2d - Terra Bella Subdivision Letter of
Credit
- MINUTE ORDER #458/04: The County Engineer presented
the matter of Mr. Joe Ritchie's request to reduce the original $200,000.00
Letter of Credit for the Terra Bella Subdivision to $75,000.00 since 80%
of the work has been completed. After due discussion, upon motion of COMMISSIONER
BROWN, seconded by COMMISSIONER FISHER, the Court
unanimously approved such action.
Agenda #2e - Variance to Subdivision Regulations
- MINUTE ORDER #459/04: The County Engineer presented
the request of Dr. Stephen J. Vancura with respect to a variance to the
County's Subdivision Regulations for the division of 1.52 acres out the
J.J. Teague Survey, Abstract #817. He explained that Dr. Vancura
is separating this 1.52 acre tract from the larger 75 acre tract, for the
purpose of building a home on the 1.52 acres. This 1.52 acre tract
will have access to FM 2484 via an access easement, 50' in width. It
was further pointed out that this would be permitted provided that Dr.
Vancura provided Bell County with a Deed Restriction, on the remainder of
the property that would state a properly prepared subdivision plat would
be required for any future division of the larger tract. The
Engineer presented the affidavit signed by Dr. Vancura stating what the
County had requested. Upon motion of COMMISSIONER
BROWN, seconded by COMMISSIONER SCHILLER, the Court
unanimously approved such variance and authorized the County Clerk to file
the necessary certifications in the Official Public Records of Bell
County, Texas.
Agenda #2f - Public Hearing on Abandonment of a
Portion of Reese Creek Road
- MINUTE ORDER #460/04: The County Engineer presented
the matter of the holding of a public hearing for the abandonment by the
County of a portion of Reese Creek Road. After due discussion, upon motion of COMMISSIONER
FISHER, seconded by COMMISSIONER CORTESE, the Court
unanimously approved setting a public hearing for the abandonment for nine
a.m. on Monday, January 31, 2005.
Agenda #2g - Final Plat for Central Texas Christian
School Addition
- MINUTE ORDER #461/04: Upon motion of COMMISSIONER
CORTESE, seconded by COMMISSIONER SCHILLER, the Court
unanimously approved the final plat for Central Texas Christian School
Addition Subdivision and ordered the same filed for record.
Agenda #3 - Personnel
- MINUTE ORDER #462/04: Upon motion of COMMISSIONER
FISHER, seconded by COMMISSIONER BROWN, the Court
unanimously approved all employee status report forms, the same being attached hereto and made a part of these
minutes.
Agenda #4 - Tax Increment Reinvestment Zone
- MINUTE ORDER #463/04: Upon motion of COMMISSIONER
CORTESE,
seconded by JUDGE BURROWS, the Court
unanimously approved a Resolution in Support of the establishment of a Tax
Increment Reinvestment Zone in the City of Belton under the Tax Increment
Financing Act and the appointment of JUDGE BURROWS and COMMISSIONER
CORTESE to such Board of Directors, and the further support for
the Bell County Museum with the expenditure of $100,000.00 from such Tax
Increment Zone for the addition to the Museum. All according to a
copy of such resolution attached hereto and made a part of these
minutes.
Agenda #5 - Resolution concerning WCID #5 Grant
- MINUTE ORDER #464/04: The matter of approval of a
Resolution for Contract Amendment for the Bell County WCID #5 approved
2004 Texas Community Development Program contract with the Office of Rural
Affairs was presented and after due discussion, upon motion of COMMISSIONER
SCHILLER, seconded by COMMISSIONER BROWN, the Court
unanimously approved such resolution, all according to a copy of the same
attached hereto and made a part of these minutes.
Agenda #6 - Claims
- MINUTE ORDER #465/04: The County Auditor presented
all claims for the review of the Court. After proper review, upon
motion of COMMISSIONER BROWN, seconded by COMMISSIONER
CORTESE, the Court unanimously approved all such claims. All
according to a copy of the same being of record in the office of the
County Auditor.
Agenda #7 - Public Hearing concerning Central
Texas Christian School Project
- MINUTE ORDER #466/04: It being 9:30 a.m. JUDGE
BURROWS opened the public hearing regarding the issuance of Italy
Higher Education Facilities Corporation Education Revenue Bonds for the
Central Texas Christian School Project - Series 2004 and asked if there
were any public comment; there being none, the public hearing was closed.
(The Court then went into workshop to discuss those items on the
workshop agenda with no action being taken on any item. The Court
recessed it's workshop meeting until 1:30 p.m. and with all members
aforementioned present in open Court, the following transpired.)
Agenda #7 & #8 - Public Hearing on Central
Texas Christian School Project
- MINUTE ORDER #467/04: (Judge Burrows announced in
the Commissioners Court Room that the Public Hearing for the Central Texas
Christian School Project at 1:30 p.m. would be held in the adjacent
Commissioners Court Conference Room.) JUDGE BURROWS called
the meeting to order and thereafter opened the public hearing on the
issuance of Italy Higher Education Facilities Corporation Education
Revenue Bond for the Central Texas Christian School Project - Series 2004
and asked if there were any public comment. There being none, the
public hearing was closed and thereafter upon motion of COMMISSIONER
CORTESE, seconded by COMMISSIONER BROWN, the Court
unanimously approved adoption of an Order approving issuance of Italy
Higher Education Facilities Corporation Education Revenue Bond for the
Central Texas Christian School Project - Series 2004, all according to a
copy of such Order attached hereto and made a part of these minutes for
all purposes.
There being no further business, the meeting
adjourned.
