AFTER proper posting of public notice, a copy of which is attached hereto, on this the 24th day of January, 2005, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #12 - Annual Presentation of Sheriff's Awards

    • MINUTE ORDER #20/05:  Sheriff Dan Smith made his annual presentation of Sheriff's Awards, all according to a copy of the same attached hereto. 



  2. Agenda #1 - Minutes

    • MINUTE ORDER #21/05:  It being nine a.m., JUDGE BURROWS called the meeting to order and called to the Courts attention the fact that they had previously received copies of the minutes of  January 10, 2005.  He asked if there were any corrections or additions to the minutes; there being no corrections, the minutes were approved as submitted. 



  3. Agenda #2a - Iduma Trail Subdivision

    • MINUTE ORDER #22/05:  The County Engineer presented the matter of the final plat for Iduma Trail Subdivision and recommended its approval.  After due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER BROWN with COMMISSIONER CORTESE voting "NO" and COMMISSIONER LANGE voting "YES," the Court approved such final plat except that the roads therein are NOT accepted for maintenance until such time as a separate easement for the cul-de-sac is recorded in the Official Public Records of Bell County. 



  4. Agenda #2b - Road Remainder Off Of FM 487

    • MINUTE ORDER #23/05:  COMMISSIONER CORTESE presented the matter of a portion of an old county road and 1.731 acres of land left when FM 487 near Bartlett was built.  The Court discussed at length with the affected landowners, Mr. & Mrs. Alvin Weber and Ms. Katherine Krause Fritsche the various problems with respect to this problem.  Mr. Edwin Krause also spoke briefly.  The problem being that the old County road which has not been officially abandoned by Bell County and now serves as the Webers entry to FM 487 is owned by Ms. Fritsche who wants the road abandoned and the Webers do not want it abandoned, but rather would like to have the County begin maintaining the same again.  No action was taken by the Court, but rather the Court requested both parties to try to reach some kind of agreement because Bell County did not want to begin maintenance on the road nor abandon the same until such an agreement could be reached. 



  5. Agenda #3 - Personnel

    • MINUTE ORDER #24/05:  Upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER CORTESE, the Court unanimously approved all employee status report forms, the same being attached hereto and made a part of these minutes. 



  6. Agenda #4 - Victims of Crimes Act Grant

    • MINUTE ORDER #25/05:  District Attorney Henry Garza presented the grant application for Victims of Crimes Act for his office and after due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously approved such grant application; all according to a copy of the same attached hereto and made a part of these minutes. 



  7. Agenda #5 - Resolution of Sheriff's Department

    • MINUTE ORDER #26/05:  The Court considered the matter of a Resolution of support for a training agreement between the Bell County Sheriff's Office and the Texas Commission on Law Enforcement Standards and Education.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved such resolution of support and authorized JUDGE BURROWS to sign the same on behalf of Bell County; all according to a copy of the same attached hereto and made a part of these minutes. 



  8. Agenda #6 - Annual Report of Bell County Museum

    • MINUTE ORDER #27/05:  Ms. Stephanie Turnham, Director of the Bell County Museum appeared before the Court to give the annual report of activities of the Bell County Museum and to report of officers and Board Members.  She reported that the offices as recommended by the Board were as follows:  Victor Means, Chairman; Dennis Turk, Vice-Chair; Bill Clark, Treasurer; and John Odom, Secretary.  She further reported that Helen Pickle was recommended as a Board Member to replace E. A. Limmer, who was going off the Board.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved the annual report of Museum (the same attached hereto) approved the officers of the Board of Trustees and approved the new Board Member. 



  9. Agenda #7 - WCID #5 Agreement

    • MINUTE ORDER #28/05:  Upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously approved the Agreement between Bell County Water Control and Improvement District No. 5 and Bell County regarding actions as the County's fiscal agent for TCDP Contract. 



  10. Agenda #8 - Contract for Testing Services for Courts' Building and County Engineer

    • MINUTE ORDER #29/05:  Upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER CORTESE, the Court unanimously approved the ratification of a contract with Kleinfelder for testing services for the new Courts' Building and the County Engineer's Office. 



  11. Agenda #9 - Ratification of Contract with Gene Doss Construction, Inc.

    • MINUTE ORDER #30/05:  No action was taken by the Court on the ratification of various contracts for Bell County. 



  12. Agenda #10 - Juvenile Detention Center Contract with COPO, Inc.

    • MINUTE ORDER #31/05:  Upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER BROWN, the Court unanimously approved the amendment/modification to the Juvenile Detention Center contract with COPO, Inc.  All according to a copy of the same attached hereto and made a part of these minutes.  



  13. Agenda #11 - Agreement with Texas Department of Transportation

    • MINUTE ORDER #32/05:  The County Engineer presented the matter of the request of the Texas Department of Transportation to consider an Agreement to Contribute Funds for Bell County's 10% participation for a hardship parcel that is located on the project known as US 190: 2 miles south of FM 436 to Milam County line known as ROW CSJ No. 0185-01-35.  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously approved ratification of authorizing the County Judge to execute such agreement to contribute funds and authorized the County Auditor to transmit the $4000.00 required under such agreement.  All according to a copy of such agreement attached hereto and made a part of these minutes. 



  14. Agenda #13 - Claims

    • MINUTE ORDER #33/05:  The County Auditor presented all claims for the review of the Court.  After proper review, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved all such claims.  All according to a copy of the same being of record in the office of the County Auditor. 


    • (The Court then went into workshop session to discuss those items on the workshop agenda with no action being taken on any item.)


              There being no further business, the meeting adjourned.
