AFTER proper posting of public notice, a copy of which is attached hereto, on this the 31st day of January, 2005, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #34/05:  It being nine a.m., JUDGE BURROWS called the meeting to order and called to the Courts attention the fact that they had previously received copies of the minutes of  January 24, 2005.  He asked if there were any corrections or additions to the minutes; there being no corrections, the minutes were approved as submitted. 



  2. Agenda #2a - Public Hearing concerning Abandonment of a Portion of Reese Creek Road

    • MINUTE ORDER #35/05:  JUDGE BURROWS opened the public hearing on the proposed closing of a portion of the Reese Creek Road.  The County Engineer reported to the Court that since the posting of the proposed closure, there have been several calls from residents along various portions of the road.  Once they understood what portion of the road was being closed, they had no objections.  However, the City of Killeen has now taken the position that they do not want the road abandoned by the County.  They envision the future use of this roadway as providing access to the property (now part of Fort Hood) that lies between Reese Creek Road and S. H. 201.  Since S. H. 201 is a limited access highway, access to much of the land will have to come from service roads, and they figure Reese Creek to be the future service road.  Mr. Benton Goodnight and Mrs. Becky Stephenson, the only two landowners affected spoke for the closure. There being no further public comment, JUDGE BURROWS closed the public hearing, and thereafter, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER BROWN the Court unanimously approved tabling such matter for two weeks to discuss the matter further with the City of Killeen. 



  3. Agenda #2b - B & L Estates Subdivision

    • MINUTE ORDER #36/05:  The County Engineer submitted the final plat for B & L Estates Subdivision and recommended its approval.  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously approved such subdivision plat and ordered the same filed for record. 



  4. Agenda #2c - Huffman Subdivision

    • MINUTE ORDER #37/05:  The County Engineer submitted the final plat of Huffman Subdivision and recommended its approval.  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously approved such subdivision plat and ordered the same filed for record. 



  5. Agenda #2d - Releasing Letter of Credit

    • MINUTE ORDER #38/05:  The County Engineer presented the matter of releasing Letter of Credit #553, First National Bank, in the amount of $25,893.60, for the maintenance of improvements in Wells Ranch, Phase III.  After due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER CORTESE, the Court unanimously approved the releasing of such Letter of Credit.  



  6. Agenda #3 - Personnel

    • MINUTE ORDER #39/05:  Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved all employee status report forms, the same being attached hereto and made a part of these minutes. 



  7. Agenda #4 - Easement for Bell County Museum

    • MINUTE ORDER #40/05:  The Court considered the request of TXU Electric Delivery Company for approval of a ten foot by approximately 150 foot easement and right of way next to the alley behind the Bell County Museum for the providing of utilities for the expansion and renovation of the Bell County Museum.  



  8. Agenda #5 - Revised Resolution for the Juvenile Crime Victim's Assistance Grant

    • MINUTE ORDER #41/05:  Upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER LANGE, the Court unanimously authorized JUDGE BURROWS to execute a revised Resolution to clarify designation of Authorized Official for the Juvenile Crime Victim's Assistance Unit, CJD Grant Number VA-04-V30-13533-07 for Victim Crime Act Funding.  All according to a copy of the same attached hereto and made a part of these minutes.  



  9. Agenda #6 - Approval of Contract with Gene Doss Construction , Inc.

    • MINUTE ORDER #42/05:  Upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved and ratified the contract with Gene Doss Construction, Inc. as Construction Manager at Risk for three Bell County building projects, to-wit: 1) renovation of the document storage building at 120 North Penelope in Belton;  2) renovation of the Tax Assessor-Collector's Licensing and Registration office at 411 East Central in Belton; and 3) finishing out of one wing at the Bell County Communications Center at 708 W. Avenue O in Belton for the aggregate amount not to exceed $312,500.00 



  10. Agenda #7 - Final Budget Amendment for FY 2004

    • MINUTE ORDER #43/05:  Upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER FISHER, the Court unanimously approved the final budget amendment for FY 2004 as presented by the County Auditor, all according to a copy of the same attached hereto and made a part of these minutes. 


      (The Court then went into workshop session to discuss those items on the workshop agenda with no action being taken on any item.)


              There being no further business, the meeting adjourned.
