AFTER proper posting of public notice, a copy of which is attached hereto, on this the 14th day of February, A. D. 2005, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #54/05:  It being nine a.m., JUDGE BURROWS called the meeting to order and called to the Courts attention the fact that they had previously received copies of the minutes of January 31 and February 7, 2005.  He asked if there were any corrections or additions, there being no corrections, the minutes were approved as submitted.   



  2. Agenda #2a - Public Hearing on Traffic Control Devices

    • MINUTE ORDER #55/05:  JUDGE BURROWS opened the public hearing concerning traffic control devices as follows:  1) The installation of a STOP sign at the intersection of Barnes Road and Armstrong Road;  2) The installation of a STOP sign at the intersection of Moth Road (a private road) and Peaceable Kingdom Road.  He asked if there were any public comments; there being none, the public hearing was closed and thereafter, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER FISHER the Court unanimously approved the installation of such traffic control devices. 



  3. Agenda #2b - Abandonment of a portion of Reese Creek Road

    • MINUTE ORDER #56/05:  COMMISSIONER FISHER reported to the Court that he had talked to the City Manager of Killeen, Texas, who had asked that the Court delay action on this matter until such time as the City completed their study of the need for this road.  Thereafter, COMMISSIONER FISHER moved that the Court delay action on the matter of the abandonment of a portion of Reese Creek Road up to 30 days; the motion was seconded by COMMISSIONER BROWN; the motion passed unanimously. 



  4. Agenda #2c - Walnut Creek Estates, Phase Six Final Plat

    • MINUTE ORDER #57/05:  Upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER LANGE, the Court unanimously approved the final plat of Walnut Creek Estates, Phase Six Final Plat and ordered the same filed for record. 



  5. Agenda #2d - Circle S Storage Subdivision Final Plat

    • MINUTE ORDER #58/05:  Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved the final plat of the Circle S Storage Subdivision and ordered the same filed for record. 



  6. Agenda #2e - Awards of Materials Bid for the Road and Bridge Department

    • MINUTE ORDER #49/05:  The County Engineer made records on each item bid and recommended their awarding to the Court as follows:

              Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved the awarding of the bid for MC-30 Asphalt to Cleveland Asphalt in the amount of $1.6265 per gallon. 
               Upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER FISHER, the Court unanimously approved the awarding of the bid for HFRS-2 Asphalt to Koch Asphalt Company in the amount of $0.864 per gallon with a secondary bid to Cleveland Asphalt in the unlikely even that Koch could not provide the material when needed. 
               Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved the awarding of the bid for Concrete to Belcrete of Belton with a secondary bid to Killeen Ready Mix, and Pro-Mix of Temple. 
               Upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER FISHER, the Court unanimously approved the awarding of the bid for Cold Mix to Vulcan Materials in the amount of $37.56 per ton delivered to Belton. 
               Upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER BROWN, the Court unanimously approved the awarding of the bid for Hot Mix to Austin Asphalt in the amount of $28.50 per ton and a secondary bid to Central Texas Asphalt in the amount of $30.00 per ton. 
               Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved the awarding of the bid for Lime in the amount of $82.09 to Austin White Lime. 
               Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER FISHER, the Court unanimously approved the awarding of the bid for Cement to TXI of Austin in the amount of $119.55 per ton delivered to Bell County. 
               Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved the awarding of the bid for aggregate to TXI, Trinity and Mine Services. 
               Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved the awarding of the bid for Pit-run gravel to Billie Lemanski of Holland; Johnnie Kelley of Holland; and Jim Fisher of Holland. 
              



  7. Agenda #3 - Personnel

    • MINUTE ORDER #60/05:  Upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER BROWN, the Court unanimously approved all employee status report forms, the same being attached hereto and made a part of these minutes.  



  8. Agenda #4 - Canvass the Village of Stillhouse Incorporation Results

    • MINUTE ORDER #61/05:  JUDGE BURROWS presented the matter of the canvassing of the results of the municipal incorporation election of the Village of Stillhouse held on February 5, 2005.  He reported that the tabulation as prepared by the County Clerk reflect 116 votes for the issue and 130 votes against the issue.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved such tabulation.  All according to a copy of the same attached hereto and made a part of these minutes.  



  9. Agenda #5 - Agreement to Contribute Funds

    • MINUTE ORDER #62/05:  JUDGE BURROWS presented the matter of an Agreement with the Texas Department of Transportation to participate in the purchasing of Right of Way and reimbursable utility adjustments for a highway project on Highway 190 from the Temple South City Limits to 2.0 miles South of FM 436 in Heidenheimer at an estimated cost to Bell County of $203,564.00, which represents 10% of the estimated total cost of the Right of Way, and approval of budget amendment if appropriate.  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously authorized the County Auditor to make such payment to the Texas Department of Transportation out of bond funds previously approved by the Court for this purpose.  All according to a copy of such agreement attached hereto and made a part of these minutes. 



  10. Agenda #6 - Interlocal Agreement with the City of Belton

    • MINUTE ORDER #63/05:  Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved authorizing JUDGE BURROWS to execute, on behalf of Bell County, the interlocal agreement with the City of Belton for sewer line construction by Bell County, by its contractors, for a portion of Miller Heights Trunk Sewer line to be funded with funds from the Belton Development Corporation in the amount of $93,849.00.  All according to a copy of such Agreement attached hereto and made a part of these minutes. 



  11. Agenda #7 - Interlocal Agreement with the City of Belton

    • MINUTE ORDER #64/05:  Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved authorizing JUDGE BURROWS to execute, on behalf of Bell County, the interlocal agreement with the City of Belton concerning the operation, funding, and other details of Reinvestment Zone Number One of the City of Belton, a Tax Increment Reinvestment Zone.  All according to a copy of the same attached hereto and made a part of these minutes.  



  12. Agenda #8 - Agreement with Corps of Engineer

    • MINUTE ORDER #65/05:  Mr. Dan Thompson representing the Corps of Engineer appeared before the Court to present the matter of the annual Law Enforcement Cooperative Agreement between Bell County, through its Sheriff's Department, and the U.S. Army Corps of Engineers for the Lake Patrols by the Sheriff's Department.  After due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER BROWN, the Court unanimously approved authorizing JUDGE BURROWS to execute the Agreement with the Corps of Engineers, on behalf of Bell County, for the providing of law enforcement on Lakes Belton and Stillhouse by the Sheriff's Department.  All according to a copy of the same attached hereto and made a part of these minutes for all purposes.  



  13. Agenda #9 - Claims

    • MINUTE ORDER #66/05:  The County Auditor presented all claims for the review of the Court.  Upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved all such claims.  All according to a copy of the same on record in the office of the County Auditor. 


      (The Court then went into workshop session to discuss those items on the workshop agenda with no action being taken on the same.)


              There being no further business, the meeting was adjourned.
