AFTER proper posting of public notice, a copy of which is attached hereto, on this the 28th day of February, 2005, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #75/05:  It being nine a.m., JUDGE BURROWS called the meeting to order and called to the Courts attention the fact that they had previously received copies of the minutes of February 22 2005.  He asked if there were any corrections or additions to the minutes; there being no corrections, the minutes were approved as submitted.   



  2. Agenda #2a - Sale of Flat Car

    • MINUTE ORDER #76/05:  The County Engineer presented the matter of the bids on the flat car on Berger Road.  He reported to the Court that bids were opened on February 22, 2005 and only one bid for $15.00 was received.  His recommendation is that the bids be rejected and that the Court discuss the disposition of this flat car, as well as the other four flat cars that were sold a year ago and are still setting on the sides of the roads.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved the acceptance of the County Engineer's recommendation.   



  3. Agenda #2b - Amended Plat of Mill Creek Springs, Phase IV

    • MINUTE ORDER #77/05:  Upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved the final plat of Mill Creek Springs, Phase IV, Amended being an Amended Plat of Lots 2-7, Block 7, Mill Creek Springs, Phase IV, and ordered the same filed for record. 



  4. Agenda #3 - Personnel

    • MINUTE ORDER #78/05:  Mr. John Crosby, Chairman of the Killeen-Fort Hood United Way presented the Court with a certificate thanking Bell County Employees for their contribution.  Upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER LANGE, the Court unanimously approved all employee status report forms, the same being attached hereto and made a part of these minutes.  



  5. Agenda #4 - Resolution Concerning Request for a new District Court in Bell County, Texas

    • MINUTE ORDER #79/05: District Judge, Rick Morris, made a presentation to the Court (a copy of the same being attached) in support of all District Judges request for legislation for a new District Court.  JUDGE BURROWS opened a public hearing for discussion of the same.  The following individuals spoke in support of such request.  Jack Jones, President Elect of the Bell County Bar Association;  Mark Whitaker and e-mails were read from Jim Bowmer; Mike Miller; Fletcher Rhoades; and Jack Crews.  There being no other comments, the public hearing was closed.  Thereafter, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER LANGE, the Court unanimously approved a resolution in support of legislation to become effective January 1, 2007, for the implementing of a new District Court for Bell County.  All according to a copy of the same attached hereto and made a part of these minutes.  



  6. Agenda #5 - Revenue Bond for the Roman Catholic Diocese of Austin

    • MINUTE ORDER #80/05:  JUDGE BURROWS presented the matter of consideration of approval of an Order under Section 147(f) of the Internal Revenue Code of the issuance of revenue bonds by the Capital Area Cultural Education Facilities Finance Corporation in the aggregate principal amount not in excess of $100,000,000.00 for the purpose of providing funds for projects of The Roman Catholic Diocese of Austin, some of which are in Bell County, in which Bell County shall have no responsibility or liability for the payment of the bonds, nor shall any of Bell County's assets be pledged for payment of the bonds, with the sole purpose of the approval being for interest on the bonds to be tax-exempt for federal income tax purposes under Section 147(f) of the Internal Revenue Code.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER FISHER, the Court unanimously approved such order; all according to a copy of the same attached hereto and made a part of these minutes. 



  7. Agenda #6 - Claims

    • MINUTE ORDER #81/05:  (There were no claims for presentation.) 


      (The Court then went into workshop session to discuss those items on the workshop agenda with no action being taken on any item.)


              There being no further business, the meeting adjourned.
