met in the Commissioners' Courtroom in Belton, Texas, in regular session with the

Agenda #1 - Minutes
- MINUTE ORDER #108/05: It being nine a.m., JUDGE
BURROWS called the meeting to order and called to the Courts
attention the fact that they had previously received copies of the minutes
of March 21, 2005. He asked if there were
any corrections or additions to the minutes; there being no corrections, the minutes were
approved as submitted.
Agenda #2a - Public Hearing on Installation of
Traffic Control Devices
- MINUTE ORDER #109/05: JUDGE BURROWS opened
the public hearing on the installation of traffic control devices by the
Road and Bridge Department. Such devices are to be installed as
follows: 1) Install Yield Right of Way sign at the intersection of
Francis Lane at Shanklin Road; 2) Install stop sign at the
intersection of Cedar Oaks Circle at Moffat Road; and 3) Install stop sign
at the intersection of Frederick Lane at Cedar Ridge Park Road. He
asked if there were any public comments; there being none, the
public hearing was closed and thereafter, upon motion of COMMISSIONER
LANGE, seconded by COMMISSIONER CORTESE, the Court
unanimously approved the installation of the aforementioned traffic
control devices.
Agenda #2b - Leighty Subdivision
- MINUTE ORDER #110/05: The County Engineer presented
the matter of the approval of the final plat for Leighty Subdivision and
recommended its approval. After due discussion, upon motion of COMMISSIONER
LANGE, seconded by COMMISSIONER CORTESE, the Court
unanimously approved such subdivision and ordered the same filed for
record.
Agenda #2c - FEMA Community Partner Memorandum of
Agreement
- MINUTE ORDER #111/05: The Engineer presented
the matter of entering into an Agreement with FEMA for the purpose of
updating the Flood Plain Maps of Bell County. After due discussion, upon motion of COMMISSIONER
BROWN, seconded by COMMISSIONER FISHER, the Court
unanimously approved authorizing JUDGE BURROWS to execute
such Memorandum of Agreement for the updating of the Flood Plain Maps of
Bell County. A copy of such MOA being attached hereto. The
Engineer reported that the firm of Halff Associates of Fort Worth would be
doing the work on the maps.
Agenda #3 - Personnel
- MINUTE ORDER #112/05: Upon motion of COMMISSIONER
CORTESE, seconded by COMMISSIONER FISHER, the Court
unanimously approved all employee status report forms, the same being
attached hereto and made a part of these minutes.
Agenda #4 - Interlocal Agreement
- MINUTE ORDER #113/05: The matter of
considering approval of an Interlocal Agreement between Bell County, the
Cities of Temple and Killeen regarding 2005 Byrne Justice Assistance Grant
Program Award was discussed and after due discussion, upon motion of COMMISSIONER
FISHER, seconded by COMMISSIONER BROWN, the Court
unanimously approved authorizing JUDGE BURROWS to execute
such Interlocal Agreement on behalf of Bell County. All according to
a copy of the same attached hereto and made a part of these minutes.
Agenda #5 - Juvenile Accountability Program
Application
- MINUTE ORDER #114/05: The matter concerning the
approval of a submission of Juvenile Accountability Block Grant Program
Application in support of the Bell County Crime Coalition was discussed
and after due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously
approved a resolution (being attached hereto) supporting the
submission of the grant application for the Bell County Criminal
Coalition, Juvenile Accountability Block Grant to the Govern's Criminal
Justice Division.
Agenda #6 - MOA with BellNET, Inc
- MINUTE ORDER #115/05: The Court discussed the matter
of the approval of a Memorandum of Agreement with BellNET, Inc. regarding
the usage of Portal Software and Web Site Hosting for the Bell County HELP
Center in Temple and Killeen. After due discussion, upon motion of COMMISSIONER
BROWN, seconded by COMMISSIONER FISHER, the Court
unanimously approved authorizing JUDGE BURROWS to execute
such MOA on behalf of Bell County (the same being attached hereto).
Agenda #7 - Judge Burrows' Financial Report about
Bell County
- MINUTE ORDER #116/05: JUDGE BURROWS gave
a report on updated financial ratings for Bell County issued by Standard
& Poor's Rating Services, giving an "AA" rating and Moody's
Investors Service, giving an "Aa3" rating, with both agencies
commenting on the well maintained financial operations and modest debt
profile of Bell County. Mr. Gary Kimble of 1st Southwest Company,
the County's financial advisor discussed with the Court their financial
standing and made a presentation concerning the healthy financial standing
of the County.
Agenda #8 - Order Authorizing Issuance of Bond for
Road and Bridge Department
- MINUTE ORDER #117/05: Mr. Dan Plietz, the County's
Bond Counsel, appeared before the Court to discuss the Order Authorizing
the Issuance of Bell County, Texas Public Property Finance Contractual
Obligations, Series 2005 in the principal amount of $3,635,000.00 for the
purchase of 56 pieces of equipment for the Road and Bridge
Department. After due discussion, upon motion of COMMISSIONER
CORTESE, seconded by COMMISSIONER LANGE, the Court
unanimously approved such Order, the same being attached hereto and made a
part of these minutes for all purposes.
Agenda #9 - Limited Tax Refunding Bonds, Series 2005
- MINUTE ORDER #118/05: JUDGE BURROWS presented,
for the consideration of the Court an Order authorizing the Issuance of
Bell County, Texas, Limited Tax Refunding Bonds, Series 2005 in the
principal amount of $6,535,000.00 specifying the terms and features of
said bonds; levying a continuing direct annual ad valorem tax for the
payment of said bonds; and resolving other matters incident and related to
the issuance, sale, payment and delivery of said bonds, including the
approval and execution of a paying/registrar agreement and a purchase
contract and the approval and distribution of an official statement;
providing for the redemption of the obligations being refunded; and
providing an effective date. (Refinancing of an existing debt at a
lower interest rate resulting in a net present value savings of
approximately $200,000.00). After due discussion, upon motion of COMMISSIONER
FISHER, seconded by COMMISSIONER BROWN, the Court
unanimously approved such Order all according to a copy of such Order
being attached hereto and made a part of these minutes for all purposes.
Agenda #10 - Sale of surplus radios and equipment on
E-bay
- MINUTE ORDER #119/05: Assistant County Auditor
Russell Williams presented the matter of declaring old radios and radio
equipment as surplus and authorizing their sale via E-bay. After due discussion, upon motion of COMMISSIONER
FISHER, seconded by COMMISSIONER LANGE, the Court
unanimously approved authorizing such sale, all according to a copy of
such equipment attached hereto and made a part of these minutes for all
purposes.
Agenda #11 - Government Finance Office Association
Award
- MINUTE ORDER #120/05: JUDGE BURROWS presented
to the County Auditor, Donna Eakin, the Government Finance Office
Association's Award for Bell County's Comprehensive Financial Report for
the Fiscal Year ending September 30, 2003.
Agenda #12 - FY 2004 Annual Outside Audit Report
- MINUTE ORDER #121/05: A representative of the
County's Outside Auditors presented the FY 2004 Annual Audit Report and
after due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER
LANGE, the Court
unanimously approved such Audit, all according to a copy of the same on
file in the office County Clerk.
Agenda #13 - Claims
- MINUTE ORDER #122/05: The County Auditor presented
all claims for the review of the Court. After proper review, upon
motion of COMMISSIONER BROWN, seconded by COMMISSIONER
CORTESE, the Court unanimously approved all such claims. All
according to a copy of the same being of record in the office of the
County Auditor.
(The Court then went into workshop session to discuss those items on
the workshop agenda with no action being taken on any item.)
There being no further business, the meeting
adjourned.
