AFTER proper posting of public notice, a copy of which is attached hereto, on this the 12th day of July, 2005, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #272/05:  It being nine a.m., JUDGE BURROWS called the meeting to order and called to the Courts attention the fact that they had received the minutes of July 5, 2005.  After due discussion, the minutes were approved as submitted.   



  2. Agenda #2a - MC-prime oil and HFRS-2emulsion

    • MINUTE ORDER #273/05:  County Engineer Richard Macchi presented that matter of consideration for the County Engineer to advertise for bids for furnishing MC-30 prime oil and HFRS-2emulsion. Upon the recommendation of the County Engineer, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved for the County Engineer to advertise for bids.    



  3. Agenda #2b - High Crest Subdivision

    • MINUTE ORDER #274/05:  County Engineer Richard Macchi presented the matter to consider variance to section 303.2 of the Bell County Subdivision Regulations for High Crest Subdivision.  Upon the recommendation of the County Engineer, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved variance to section 303.2 for High Crest Subdivision. 



  4. Agenda #2c - TxDOT Offer of Surplus Right of Way on FM 487

    • MINUTE ORDER #275/05:  County Engineer Richard Macchi presented the consideration fro TxDOT for the offer of Surplus Right of Way on FM 487 (0.341 acres in the William C. Wilson Survey, Abstract 856, the same being attached hereto and made a part of these minutes.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved not to maintain Right of Way and rejected offer from TxDOT.      



  5. Agenda #2d - Purchase of Fleet Management Software Package

    • MINUTE ORDER #276/05:  County Engineer Richard Macchi presented the matter of authorizing the purchase of a Fleet Management Software package from Ron Turley Associates, Phoenix, AZ and making the necessary budget amendment.   After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER FISHER,  the Court unanimously approved the purchase of a Fleet Management Software package.    



  6. Agenda #2e - Final Plat for Westside Church of Christ

    • MINUTE ORDER #277/05:  County Engineer Richard Macchi presented the matter for approval of the Final Plat for Westside Church of Christ, a One-Lot, 3.205 Acre Subdivision off of Bunny Trail, and partially within the city limits of the City of Killeen. After due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER BROWN, the Court unanimously approved the Final Plat for Westside Church of Christ. 



  7. Agenda #2f - Rescinding purchase of Gradall XL-3100

    • MINUTE ORDER #278/05:  County Engineer Richard Macchi presented the matter of rescinding Commissioners' Court action of June 27, 2005, regarding the purchase of a Gradall XL-3100 off of the State Contract and authorizing County Engineer to advertise for bids on the purchase of this piece of equipment.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved to rescind the actions of Commissioners' Court from June 27, 2005 for the purchase of a Gradall XL-3100. 



  8. Agenda #3 - Personnel

    • MINUTE ORDER #279/05:  Upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER LANGE, the Court unanimously approved all employee status report forms, the same being attached hereto and made a part of these minutes.  



  9. Agenda #4 - Update on changes to S.B. 6

    • MINUTE ORDER #280/05:  County Judge Jon H. Burrows discussed S.B. 6 and what actions were in the process to remove or fund the estimated $2.5 million unfunded mandate to Bell County.  Representatives from Senator Troy Fraser, and Diane Delisi were present and both stated that no action has been made until after the upcoming meeting later in the week.  District Judge Rick Morris of the 169th Court addressed the Court, and present was Judge Charles Van Orden, Administrator of Child Protective Services.  Judge Jon H. Burrows read a letter from Suzanna Gratia Hupp, Rep. District 54, a copy of which is attached hereto and made a part of these minutes.  The Court recognized Attorney Neal Potts and Attorney John Messer for their part with Bell County and the consideration they have for the individuals they represent in the District Courts of Bell County.   



  10. Agenda #5 - Employee Health and Dental Insurance

    • MINUTE ORDER #281/05:  Human Resource Director, Ron Heuss presented for consideration the selection and award of proposals for employee health and dental insurance.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously accepted the proposal for employee health and dental insurance, the same being attached hereto and made a part of these minutes.   



  11. Agenda #6 - Skanska Construction Company

    • MINUTE ORDER #282/05:  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved the Change Order No 3 with Skanska Construction Company for adjustments to District Courts project that result in no change to the Guaranteed Maximum Price, the same being attached hereto and made a part of these minutes. 



  12. Agenda #7 - Contract Extension by Central Texas Workforce

    • MINUTE ORDER #283/05:  Upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER BROWN, the Court unanimously approved the contract extension from July 1 through September 30, 2005 for funding by Central Texas Workforce of 211 staffing by Bell County, the same being attached hereto and made a part of these minutes. 



  13. Agenda #8 - Claims

    • MINUTE ORDER #284/05:  JUDGE JON H. BURROWS, County Judge presented the claims for the review of the Court.  After proper review, upon the motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved all such claims.  All according to a copy of the same being of record in the office of the County Auditor. 


    • (The Court then went into workshop session to discuss those items on the workshop agenda with no action being taken on any item.)


              There being no further business, the meeting adjourned.
