AFTER proper posting of public notice, a copy of which is attached hereto, on this the 1st day of August, 2005, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #305/05:  It being nine a.m., JUDGE JON H. BURROWS, called the meeting to order and called to the Courts attention the fact that they had received the minutes of July 25, 2005.  After due discussion, the minutes were approved as submitted.   



  2. Agenda #2a 1. - Right of Way fencing on Round Hall Road

    • MINUTE ORDER #306/05:  Richard Macchi, County Engineer presented the matter of awarding bids for Right of Way fencing on Round Hall Road (Precinct 1).  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously awarded the bid to Randy Benner, B & B Fencing in the amount of $7,010.17.



  3. Agenda #2a 2. - Right of Way fencing on Dove and Brewster Creek Roads

    • MINUTE ORDER #307/05:  Richard Macchi, County Engineer, presented the matter of awarding bids for Right of Way fencing on Dove and Brewster Creek Roads (Precinct 3).  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously awarded the bids to Temple Fence in the amount of $35,166.35 with the understanding that the balance may not be used immediately. 



  4. Agenda #2b - Development of Harris Community Center

    • MINUTE ORDER #308/05:  Richard Macchi, County Engineer presented the matter of approval of agreement with the City of Belton for County Participation in the development of Harris Community Center. After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved to provide the labor and equipment (only) for the construction of a 60' X 180' parking lot.  The total value of the agreement is approximately $7-8,000.00.



  5. Agenda #3 - Personnel

    • MINUTE ORDER #309/05:  Upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER CORTESE, the Court unanimously approved all employee status report forms, the same being attached hereto and made a part of these minutes.  



  6. Agenda #4 - Consideration of Burn Ban

    • MINUTE ORDER #310/05:  Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved to implement a 30 day Burn Ban beginning Wednesday, August 3, 2005 at 7:00 a.m.  This stands true unless the restrictions are terminated earlier based on a determination made by this Commissioners Court that the circumstances creating a public safety no longer exist.  The County Judge is authorized to administratively lift the ban for up to seventy-two hours upon his determination that circumstances warrant such action. 



  7. Agenda #5 - Report from District Judge Rick Morris concerning the unfunded mandate of SB 6

    • MINUTE ORDER #311/05:  District Judge, Rick Morris gave report on results of a meeting in Austin with state Legislators, Staff members, and interested parties concerning the unfunded mandate of SB 6 on Bell County.  Present in court was Attorney Neale Potts, and Judge Rick Morris, recognized was Judge Charles Van Orden for his presence in Austin. 



  8. Agenda #6 - Update from office of Rep. Hupp, Rep. Delisi, Rep Frasier on SB 6

    • MINUTE ORDER #312/05:  Judge Jon H. Burrows stated that no representatives were present; therefore, he read the attached email from Representative Suzanna Hupp which is attached hereto and made a part of these minutes. 



  9. Agenda #7 - Order granting exemption under Chap. 262 of the Local Government Code

    • MINUTE ORDER #313/05:  Consider order granting exemption under Chapter 262 of the Local Government Code for the contracting of professional services to address the mandates of SB6.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER FISHER, the Court unanimously approved resolution allowing an exemption from competitive bidding under the County Purchasing Act, Sec. 262.024(a)(4) of the Local Government Code for professional services required to address the mandates of SB 6. 



  10. Agenda #8 - Appointing Committee for Evaluations and Recommendations under SB 6

    • MINUTE ORDER #314/05:  Judge Jon H. Burrows, County Judge recommended Judge Rick Morris, Judge Charles Van Orden, Commissioner Richard Cortese, and Mike Lockett, as the committee to evaluate, negotiate, and make recommendations to the Commissioners Court concerning proposals to provide professional services under SB 6.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER FISHER, the Court unanimously approved the recommendation and appointment. 



  11. Agenda #9- Renewal of Texas VINE Maintenance Contract

    • MINUTE ORDER #315/05:  Consideration for the approval of the renewal of Texas VINE (Victim Information and Notification Everyday) Maintenance Contract between Bell County and the Office of the Attorney General (OAG) of Texas through its vendor, Appriss, Inc.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved the renewal of Texas VINE, in which the OAG will reimburse Bell County for services delivered to it by the vendor consisting of, but not limited to, notification to victims of crimes of the prosecution, incarceration, and release of persons charged or convicted of violent crimes. 



  12. Agenda #10 - Update Juvenile Code of Conduct, Policy Manual, and Procedures

    • MINUTE ORDER #316/05:  Tom Kozeny from the Juvenile Probation Office presented for approval the updated Memorandum of Understanding, updated Juvenile Code of Conduct, and updated Policy Manual and Policies and Procedures for the Bell County Juvenile Justice Alternative Education Program.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER LANGE, the Court unanimously approved all such policies and procedures.  All according to a copy of the same being attached hereto and made a part of these minutes. 



  13. Agenda #11 - Claims

    • MINUTE ORDER #317/05:  Judge Jon H. Burrows, County Judge presented the claims for review to the Court.  After proper review, upon the motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved all such claims.  All according to a copy of the same being of record in the office of the County Auditor. 


    • (The Court then went into workshop session to discuss those items on the workshop agenda with no action being taken on any item.)


              There being no further business, the meeting adjourned.
