- MINUTE ORDER #318/05: It being nine a.m., JUDGE
JON H. BURROWS, called the meeting to order and called to the Courts
attention the fact that they had received the minutes of August 01, 2005.
After due discussion, the minutes were approved as corrected.
Agenda #2a - Letter of Credit No. 324 for
improvements to Iduma Trail Subdivision
- MINUTE ORDER #319/05: Richard Macchi,
County Engineer presented the matter for consideration of
accepting the Letter of Credit No. 324, in the amount of $6,850.00 from
Union State Bank, Florence, for Maintenance of improvements in Iduma Trail
Subdivision. After due discussion, upon motion of COMMISSIONER
FISHER, seconded
by COMMISSIONER BROWN, the Court unanimously approved the
Letter of Credit No. 324.
Agenda #2b - Letter of Credit No. 463 and
releasing No. 458 from First Texas Bank
- MINUTE ORDER #320/05: Richard Macchi, County Engineer, presented
the matter of accepting Letter of Credit No. 463 and releasing No. 458,
both from First Texas Bank, Killeen, and both in the amount of $18,000.00
from improvements in Walnut Creek Estates, Phase 6. After due discussion, upon motion of
COMMISSIONER FISHER, seconded by COMMISSIONER BROWN,
the Court unanimously approved to accept Letter of Credit No. 463 and
release Letter of Credit No. 458.
Agenda #2c - Letter of Credit No. 462 and
releasing No. 456 from First Texas Bank
- MINUTE ORDER #321/05: Richard Macchi,
County Engineer presented the matter of accepting Letter of
Credit No. 462 and releasing No. 456, both from First Texas Bank, Killeen,
and both in the amount of $40,000.00 for improvements in McLean's
Crossing, Phase 6. After due discussion, upon motion of COMMISSIONER
FISHER, seconded
by COMMISSIONER BROWN, the Court unanimously approved to
accept Letter of Credit No. 462 and release Letter of Credit N. 456.
Agenda #2d - Purchase of a 24' Tractor-Mounted Brush
Cutter
- MINUTE ORDER #322/05: No action was taken on the
consideration of the purchase of a 24' Tractor-Mounted Brush Cutter
through H.G.A.C. at this time.
Agenda #2e - Purchase of a Gradall XL-3100
- MINUTE ORDER #323/05: Richard Macchi,
County Engineer presented the matter of awarding bid for the purchase of a
Gradall XL-3100. After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER
FISHER, the Court
unanimously approved to award the bid to Waukesha Pearce in the amount of
$209,786.23 for the purchase of a Gradall XL-3100.
Agenda #2f - Letter of Credit No. 599
- MINUTE ORDER #324/05: Richard Macchi, County
Engineer presented the matter of releasing Letter of Credit No. 599, First
National Bank, Killeen in the amount of $7,922.40 for the maintenance of
improvements in Crossland Estates. After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER
LANGE, the Court
unanimously approved to release Letter of Credit No. 599.

- MINUTE ORDER #325/05: Upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER
LANGE, the Court
unanimously approved all employee status report forms, the same being
attached hereto and made a part of these minutes.
Agenda #4 - Consideration of Burn Ban
- MINUTE ORDER #326/05: Upon motion of COMMISSIONER
BROWN, seconded by COMMISSIONER CORTESE, the Court
unanimously approved to immediately lift the Bell County Burn Ban.
Agenda #5 - Board of Trustees of Central Counties
MHMR Authority
- MINUTE ORDER #327/05: Judge Jon H. Burrows
presented for consideration of approval the ratification of the
appointments by other counties of their nominees for the Board of Trustees
of Central Counties MHMR Authority. After due discussion, upon
motion of COMMISSIONER CORTESE, seconded by COMMISSIONER
BROWN, the Court unanimously approved the appointment of Dr.
Forrest Harris of Hamilton County for a one-year term, and Ms. Ann King of
Milam County, and Ms. Sue Faulkner of Lampasas County for two-year terms.
Agenda #6 - Report from County Attorney Rick Miller
on the history of Bell County
- MINUTE ORDER #328/05: Bell County Attorney,
Rick Miller gave a report on his research on the history of Bell
County Elected Officials and Commissioners' Court Minutes. After due
discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER
CORTESE, the Court accepted Mr. Miller's report as given. A
copy of Mr. Miller's written report was submitted and accepted by the Bell
County Museum.
Agenda #7 - Section 22.2041 of the Texas
Government Code
- MINUTE ORDER #329/05: Judge Jon H. Burrows, County
Judge presented the matter of Resolution in compliance with new Section
22.2041 to the Texas Government Code, effective January 1, 2005, requiring
the setting and collection of a fee of $5.00 for each civil suit, except
for suits for delinquent taxes, with the collected fees to be forwarded
monthly to the Third Court of Appeals for expenditures by the Third Court
of Appeals for its judicial system. Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER
LANGE, the Court
unanimously accepted this resolution. All according to a copy of the
same attached hereto and made a part of these minutes.
Agenda #8 - Bell County's 10% Participation for U.S.
Highway 190 Utility Adjustments
- MINUTE ORDER #330/05: Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER
BROWN, the Court
unanimously approved the payment to Texas Department of Transportation
Bell County's 10% participation for U.S. Highway 190 Utility Adjustments
from Coryell County line to SP 172, estimated to be $17,316.00, and
necessary budget amendment for the General Fund. All according to a
copy of the same attached hereto and made a part of these minutes.
Agenda #9- Tax Abatement
- MINUTE ORDER #331/05: Upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER
CORTESE, the Court
unanimously approved the tax abatement agreement passed by the City of
Temple on July 7, 2005 with Scientific Recycling, Inc. providing for a 25%
tax abatement on real and personal property with a useful life of ten or
more years for a five year period in accordance with the City of Temple's
criteria and guidelines for tax abatements. All according to a copy
of the same attached hereto and made a part of these minutes.
Agenda #10 - Inmate Health Care
- MINUTE ORDER #332/05: Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER
BROWN, the Court
unanimously approved the Statement of Work services from SBI Enteris, Inc.
relating to establishing processes and workflows necessary to support
inmate healthcare invoice tracking and reporting processes. All
according to a copy of the same attached hereto and made a part of these
minutes.
Agenda #11 - Proposals for Testing, Adjusting, and
Balancing
- MINUTE ORDER #333/05: Upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER
FISHER, the Court
unanimously authorized entering negotiations with select firm for test and
balancing, which was Advance Air Systems, for the new District Courts
Building.
Agenda #12 - Sewer Project on Loop 121
- MINUTE ORDER #334/05: Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER
BROWN, the Court
unanimously approved for a grant match to USDA for sewer project on Loop
121 with the City of Belton, and necessary budget amendment from the
General Fund. A copy of the recommended distribution is attached
hereto and made a part of these minutes.
Agenda #13 - Claims
- MINUTE ORDER #335/05: Judge Jon H. Burrows,
County Judge presented the claims for review to the Court. After proper review, upon
the motion of COMMISSIONER BROWN, seconded by COMMISSIONER
CORTESE, the Court
unanimously approved all such claims. All according to a copy of the
same being of record in the office of the County Auditor.
(The Court then went into workshop session to discuss those items on
the workshop agenda with no action being taken on any item.)
