AFTER proper posting of public notice, a copy of which is attached hereto, on this the 7th day of November, 2005, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #456/05:  It being nine a.m., Judge Jon H. Burrows, called the regular meeting of the Commissioner's Court to order and called to the Courts attention that they had received the minutes of October 31, 2005.  After due discussion, the minutes were approved as corrected.   



  2. Agenda #2a  - Releasing Letter of Credit No. 328

    • MINUTE ORDER #457/05: After due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER CORTESE, the Court unanimously approved to release letter of credit No. 328, National Bank Copperas Cove, in the amount of $2,000.00 and accepting Letter of Credit No. 332, National Bank Copperas Cove, in the amount of $1,000.00 for Chaparral Lee's Acres. 



  3. Agenda #2b - Prime Oil

    • MINUTE ORDER #458/05:  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved to cancel contract with Cleveland Asphalt MC-30 Prime Oil due to notification they would adjust the price upward effective October 20, 2005.  This will be rebid to allow alternatives to MC-30 and shorten the time period for the bid contract to 3 months.  



  4. Agenda #2c - Household Hazardous Waste Collection

    • MINUTE ORDER #459/05:  County Engineer, Richard Macchi, gave a report regarding the success of the Household Hazardous Waste Collection Events that were conducted this year, the same being attached hereto and made a part of these minutes. 



  5. Agenda #2d - Reducing Letter of Credit No. 493

    • MINUTE ORDER #460/05:  Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved to reduce Letter of Credit No. 493, First State Bank Central Texas, from $203,848.36 to $80,000.00 for Eagle Oaks at the Lake, Phase I. 



  6. Agenda #2e - Rights of Way Fencing on Sypert Branch Road

    • MINUTE ORDER #461/05:  Upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously approved to authorize the County Engineer to advertise for bids for 3,870 feet of Right of Way fencing on Sypert Branch Road. 



  7. Agenda #2f - Railroad Tank Cars

    • MINUTE ORDER #462/05:  Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved to donate two surplus railroad tank cars to the City of Holland. 



  8. Agenda #2g - Plat for Hidden Meadow Ranch Subdivision

    • MINUTE ORDER #463/05:  Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved the plat for Hidden Meadow Ranch Subdivision.  



  9. Agenda #3 - Personnel

    • MINUTE ORDER #464/05:  Upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER CORTESE, the Court unanimously approved all employee status report forms, the same being attached hereto and made a part of these minutes.  



  10. Agenda #4 - Flu Vaccine

    • MINUTE ORDER #465/05:  Wayne Farrell, Director of the Bell County Health District, introduced Angie Ritches, also from the Bell County Health District who gave an update on the local availability of the flu vaccine and information on the Avian flu.  Angie stated that at this time there is no shortage on the regular flu vaccine.  She also stated that the Avian flu is not new; the first reported case in Texas was in 1987, and then it was not publicized as it is today.  The Avian flu at this time is only transmitted from birds to people who come in close contact with an infected bird.  It is not transmitted from person to person at this time.  More information can be found at their web site at www.cdc.gov/flu. 



  11. Agenda #5 - Report from Dan Smith on Jail

    • MINUTE ORDER #466/05:  Bell County Sheriff, Dan Smith, gave a report on the current jail status due to overcrowding, costs, and leasing.  All of this according to a copy attached hereto and made a part of these minutes. 



  12. Agenda #6 - Child Safety Fees

    • MINUTE ORDER #467/05:  Sharon Long, Tax Assessor-Collector reported on Child Safety Fees collected by Bell County in 2004-2005.  Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved the 2004-2005 Child Safety Fees, all of which a copy is attached hereto and made a part of these minutes.  



  13. Agenda #7 - Fuel Management Services

    • MINUTE ORDER #468/05:  Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved to award bid to Fuelman for two years with the option to renew for two more.   



  14. Agenda #8 - Advance Air Systems

    • MINUTE ORDER #469/05:  Upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER BROWN, the Court unanimously approved to authorize the County Judge to sign an agreement with Advance Air Systems for Testing and Balancing at the new District Courts Building.  



  15. Agenda #9 - Vehicles for Information Systems Department

    • MINUTE ORDER #470/05:  Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved to reject all bids received and rebid for two vehicles for Information Systems Department.  



  16. Agenda #10 - Lone Star Legal Aid

    • MINUTE ORDER #471/05:  Upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER BROWN, the Court unanimously approved the Memorandum of Understanding with Lone Star Legal Aid (Belton Office) for Pro Se Assisted Program and Bell County Protective Orders for FY 2006.



  17. Agenda #11 - Memorandum of Understanding

    • MINUTE ORDER #472/05:  Upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER LANGE, the Court unanimously approved the Memorandum of Understanding between Bell County and Lone Star Legal Aid.  All according to a copy of the same attached hereto and made a part of these minutes.  



  18. Agenda #12 - Texas OnLine

    • MINUTE ORDER #473/05:  Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved the Certification of Costs related to Texas OnLine in relation to the E-filing application at the October 24, 2005 Commissioners Court meeting.  All according to a copy of the same attached hereto and made a part of these minutes.  



  19. Agenda #13 - Claims

    • MINUTE ORDER #474/05:  Judge Jon H. Burrows, County Judge, presented the claims for review to the Court.  After proper review, upon the motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved all such claims.  All according to a copy of the same being of record in the office of the County Auditor. 



             (The Court then went into workshop session to discuss those items on the workshop agenda with
             no action being taken on any item.)


              There being no further business, the meeting adjourned.
