AFTER proper posting of public notice, a copy of which is attached hereto, on this the 13th day of February, 2006, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

It being nine a.m., Judge Jon H. Burrows, called the regular meeting of the Commissioner's Court to order.


  1. Agenda #1 - Minutes

    • MINUTE ORDER #068/06:   Judge Burrows presented the minutes of February 6, 2006.  There being no corrections or additions, the minutes were approved as submitted.  



  2. Agenda #2a - Utility Easement - City of Temple

    • MINUTE ORDER #069/06:   Richard Macchi, County Engineer, presented the matter to consider authorizing County Judge to sign a 20' Utility Easement tot he City of Temple for the relocation of a sewer line across Lots 1, 2, 3, and 11, Block 24, of Temple, an Addition in the City of Temple.  After due discussion, upon motion of Commissioner Lange, seconded by Commissioner Cortese, the Court unanimously approved this matter. 



  3. Agenda #2b - Awards of Material Bids for the Road and Bridge Department

    • MINUTE ORDER #070/06:   Richard Macchi, County Engineer, presented the matter to consider awarding bids for the purchase of lime, cement, concrete, asphalt, hot mix, cold mix, aggregate, and pit-run gravel.  The County Engineer made records on each item bid an recommended their awarding to the Court as follows:

          Upon motion of Commissioner Fisher, seconded by Commissioner Cortese, the Court unanimously approved the awarding of the bid for Lime to Austin White Lime in the amount of $87.36 per ton.  

          Upon motion of Commissioner Brown, seconded by Commissioner Cortese, the Court unanimously approved the awarding of the bid for Cement to TXI out of Austin in the amount of $121.00 per ton. 

          Upon motion of Commissioner Fisher, seconded by Commissioner Lange, the Court unanimously approved the awarding of the bid for Concrete to Belcrete as primary supplier in the amount of $73.00 per cubic yard and to make the secondary source Killeen Ready-Mix and Pro-Mix of Temple.

          Upon motion of Commissioner Cortese, seconded by Commissioner Lange, the Court unanimously approved the awarding of the bid for Asphalt (both prime oil and emulsion) to Sem Materials in the amount of AE-P - $1.57 per gallon and HFRS-2 - $1.22 per gallon for six month period, with the possibility of two, three-month extensions. 

          Upon motion of Commissioner Fisher, seconded by Commissioner Cortese, the Court unanimously approved the awarding of the bid for Hot Mix (HMAC) to all three companies who bid, Central Texas Asphalt of Youngsport in the amount of $38.00 per ton; Wheeler Coating/Heart of Texas Hot Mix of Kempner and Seward Junction in the amount of $36.50 per ton; and Austin Bridge & Road of Belton in the amount of $36.00 per ton, also for a six month period, with the possibility of two, three-month extensions. 

          Upon motion of Commissioner Lange, seconded by Commissioner Cortese, the Court unanimously approved the awarding of the bid for Cold Mix to all four companies who bid, Vulcan Construction Materials of Uvalde in the amount of $18.00 per ton plus shipping of $28.80; Martin Marietta Materials of Uvalde in the amount of $18.00 per ton plus shipping of $28.48;  Austin Asphalt of Belton in the amount of $48.00; and Wheeler Coatings of Georgetown in the amount of $45.00 per ton plus shipping of $5.50.

          Richard Macchi, County Engineer presented a bid from Joe Richards Inc., for various material available.  After due discussion, upon motion of Commissioner Cortese, seconded by Commissioner Lange, the Court unanimously approved the awarding of the bid to Joe Richards, Inc., to purchase all materials available and to award the bid for Aggregate to TXI as primary supplier of aggregate, with MSI, Trinity and Lanco being alternative suppliers should something go wrong with the contract with TXI or there is a serious funding shortfall in the future. 

          Upon motion of Commissioner Cortese, seconded by Commissioner Lange, the Court unanimously approved the awarding of the bid for Pit-Run Gravel to Billie J. Lemanski; Jim Fisher (no relation to Commissioner Fisher) and Johnnie Kelly. 



  4. Agenda #2c - Final Approval Moffat Springs Addition

    • MINUTE ORDER #071/06:   Richard Macchi, County Engineer, presented the matter to consider Final Approval of the Plat for Moffat Springs Addition, Phase 5 & 6, consisting of 14-Lots on a total of 10.57 acres in the E.T.J. of the City of Temple.  The developer has provided a Maintenance Letter of Credit #1024, from First Texas Bank in the amount of $5500.00, to expire one year from February 9, 2006.  After due discussion, upon motion of Commissioner Lange, seconded by Commissioner Brown, the Court unanimously approved this matter. 



  5. Agenda #3 - Personnel

    • MINUTE ORDER #072/06:  Upon motion of Commissioner Fisher, seconded by Commissioner Lange, the Court unanimously approved all employee status report forms, the same being attached hereto and made a part of these minutes.  



  6. Agenda #4 - Burn Ban

    • MINUTE ORDER #073/06:  Judge Burrows presented the matter to consider update, status, continuation, modification or lifting of Burn Ban Order and Emergency Order Concerning Burning.  After due discussion, upon motion of Commissioner Cortese, seconded by Commissioner Langeto continue with the current Burn Ban Order already in effect.



  7. Agenda #5 - Agreement with Corps of Engineer

    • MINUTE ORDER #074/06:  Mr. Dan Thomasson representing the Corps of Engineer appeared before the Court to present the matter of the approval of renewal of Annual Law Enforcement Contract with the Corps of Engineers in which the Bell County Sheriff's Office provides law enforcement services.  The contract for the 2006 recreation season is for 3,808 hours at a cost of $88,802.56.  This represents an increase in personnel and fuel cost from 2005.  The reduction in contract hours by 388 hours helped keep the total contract cost to just less than 1.5% increase of the 2005 contract.  After due discussion, upon motion of Commissioner Lange, seconded by Commissioner Fisher, the Court unanimously approved this matter. 



  8. Agenda #6 - Lever Voting Machines

    • MINUTE ORDER #075/06:  Judge Burrows presented the matter to consider results of attempt to sell lever voting machines and consider approval of other disposition options.  Russell Williams, Assistant County Auditor reported to the Court that there were no offers or inquiries regarding the sale of the machines.  After due discussion, upon motion of Commissioner Brown, seconded by Commissioner Cortese, to authorize Mr. Williams to place the sale of the machines on Ebay and continue checking in to other recommended options. 



  9. Agenda #7 - Award Bid for Professional Auctioneering Services

    • MINUTE ORDER #076/06:  Judge Burrows presented the matter to consider awarding bid for Professional Auctioneering Services.   After due discussion, upon motion of Commissioner Brown, seconded by Commissioner Lange, the Court unanimously awarded the bid to Bill Hall Auctioneer, Inc. 



  10. Agenda #8 - Award Bid for Fiber - Killeen Annex and New District Courts Building

    • MINUTE ORDER #077/06:  Judge Burrows presented the matter to consider awarding bid for installation and termination of fiber at the Killeen Annex and the new District Courts Building.  After due discussion, upon motion of Commissioner Cortese, seconded by Commissioner Brown, the Court unanimously awarded the bid to Calence of Austin. 



  11. Agenda #9 - Bell County Museum Change Order #3

    • MINUTE ORDER #078/06:  Judge Burrows presented the matter to consider approval of Change Order #3 for Gene Doss Construction, Inc. on Bell County Museum - Guffy Renovation Project.  After due discussion, upon motion of Commissioner Brown, seconded by Commissioner Cortese, the Court unanimously approved this matter.  



  12. Agenda #10 - New District Courts Building Change Order #6

    • MINUTE ORDER #079/06:  Judge Burrows presented the matter to consider approval of Architect's Change Order #6 for Skanska USA Building, Inc. for the new District Courts Building.  After due discussion, upon motion of Commissioner Brown, seconded by Commissioner Fisher, the Court unanimously approved this matter.



  13. Agenda #11 - Claims

    • MINUTE ORDER #080/06:  The County Auditor presented the claims for the review of the Court.  After proper review, upon motion of Commissioner Brown, seconded by Commissioner Cortese, the Court unanimously approved all such claims.  All according to a copy of the same being of record in the office of the County Auditor.  




      There being no further business, the meeting adjourned.



             (The Court then went into workshop session to discuss those items on the workshop agenda with
              no action being taken on any item.)
