AFTER proper posting of public notice, a copy of which is attached hereto, on this the 10th day of July, 2006, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #263/06:  It being nine a.m., Judge Jon H. Burrows, called the regular meeting of the Commissioner's Court to order and called to the Courts attention that they had received the minutes of July 3, 2006.  After due discussion, the minutes were approved as presented.



  2. Agenda #2a - Guidance Line

    • MINUTE ORDER #264/06:  County Engineer, Richard Macchi presented for approval the releasing of "Guidance Line" in the amount of $100,000 and accepting cashier's check no. 4867612362 in the amount of $7,700 for maintenance of improvements and installation of erosion control materials as specified in plans for Sunset Vista Subdivision.  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously approved this matter. 



  3. Agenda #3 - Personnel

    • MINUTE ORDER #265/06:  Upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER FISHER, the Court unanimously approved all employee status report forms, the same being attached hereto and made a part of these minutes.  



  4. Agenda #4 - Lease Agreement with USDA

    • MINUTE ORDER #266/06:  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved to authorize County Judge Jon H. Burrows to sign renewal lease agreement with USDA.



  5. Agenda #5 - Canvass of The Village of Salado Local Option Petition

    • MINUTE ORDER #267/06:  Sharon Long, Tax Assessor-Collector, presented the canvass results from the Village of Salado Local Option Petition for the legal sale of mixed beverages in restaurants by food and beverage certificate holders only, and to consider the calling of an election.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER FISHER, the Court unanimously approved the canvass and set the date of the Local Option Election for November 7, 2006. 



  6. Agenda #6 - Brazos Valley Utilities Contract

    • MINUTE ORDER #268/06:  Vicki Schultz, Kerbow and Associates Consulting, presented for approval, change order #1 for Brazos Valley Utilities Contract on the 2004 TCDP grand on behalf of Bell County W.C.I.D. #5.  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER BROWN, the Court unanimously approved this matter.


  7. Agenda #7 - Texas Community Development Program Grant Application

    • MINUTE ORDER #269/06:    Vicki Schultz, Kerbow and Associates Consulting, presented for consideration the Sponsorship of 2007/2008 Texas Community Development Program Grant Application on behalf of Bell County W.C.I.D. #5.  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER BROWN, the Court unanimously approved this matter. 



  8. Agenda #8 - AA Ratings of Bell County

    • MINUTE ORDER #270/06:  Garry Kimball, First Southwest Company, presented the report of Rating Agencies Affirming AA Ratings of Bell County.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER LANGE, the Court unanimously approved such report.


  9. Agenda #9 - Limited Tax Refunding Bonds

    • MINUTE ORDER #271/06:  Garry Kimball, First Southwest Company, presented an Order authorizing the issuance of "Bell County, Texas, Limited Tax Refunding Bonds, Series 2006" in a principal amount of $24,435,000; specifying the terms and features of said bonds; levying a continuing direct annual ad valorem tax for the payment of said bonds; and resolving other matters incident and related to the issuance, sale, payment, and delivery of said bonds, including the approval and execution of a Paying Agent/Registrar Agreement and Escrow Agreement and a Purchase Contract and the approval and distribution of an Official Statement; and providing an effective date.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the above matter was unanimously approved. 


  10. Agenda #10 - Issuance of $46,695,000 Bell County, Texas Limited Tax Notes

    • MINUTE ORDER #272/06:  Garry Kimball, First Southwest Company, presented an Order authorizing the issuance of $46,695,000 Bell County, Texas, Limited Tax Notes, Series 2006; authorizing the levy of an ad valorem tax; and resolving other matters incident and related to the issuance, sale, payment, and delivery of said noted, including approval and execution of Paying Agent/Registrar Agreement and a Purchase Contract and the approval and distribution of an Official Statement and providing an effective date.  After due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER LANGE, the Court unanimously approved this matter.


  11. Agenda #11 - Claims

    • MINUTE ORDER #273/06:   Judge Jon H. Burrows, presented the claims for review to the Court.  After proper review, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved all such claims.  All according to a copy of the same being of record in the office of the County Auditor.  


               (The Court then went into workshop session to discuss those items on the workshop agenda with
                 no action being taken on any item.)



                There being no further business, the meeting adjourned.
