AFTER proper posting of public notice, a copy of which is attached hereto, on this the 17th day of July, 2006, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #274/06:  It being nine a.m., Judge Jon H. Burrows, called the regular meeting of the Commissioner's Court to order and called to the Courts attention that they had received the minutes of July 10, 2006.  After due discussion, the minutes were approved as corrected.



  2. Agenda #2a - Traffic Control Devices

    • MINUTE ORDER #275/06:  County Engineer, Richard Macchi presented for approval the installation of the following traffic control devices:
              1.  Install STOP sign at the intersection of Guyton Road at Railroad
              2.  Install STOP sign at the intersection of Luther Curtis Road at Railroad
              3.  Install YIELD sign at the intersection of Roberts Road at Railroad
              4.  Install YIELD sign at the intersection of Mills Road at Railroad
              5.  Install YIELD sign at the intersection of Harber Road at Railroad
      Judge Jon H. Burrows opened these items for public hearing discussion, after hearing no comments the public hearing was closed.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved all traffic control devices to be installed.  



  3. Agenda #2b - Reconstruction of Lower Troy Road

    • MINUTE ORDER #276/06:  County Engineer, Richard Macchi, presented for approval the reconstruction of approximately one-half mile of Lower Troy Road to the annual work plan.  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously approved this matter. 



  4. Agenda #2c - Letter of Credit #324

    • MINUTE ORDER #277/06:  County Engineer, Richard Macchi, presented the matter of releasing Letter of Credit No. 324, Union State Bank of Florence, TX in the amount of $6,850.00 for improvements in Iduma Trail Subdivision.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved to release Letter of Credit No. 324.  COMMISSIONER FISHER abstained. 



  5. Agenda #2d - Sale of 2 CHN613 Mack Tractor Units

    • MINUTE ORDER #278/06:  County Engineer, Richard Macchi, presented for authorization the sale of two CHN613 Mack 6X4 Tractor Units and the purchase of two CHN613 Mack 6X4 Tractor Units off of the State Buy-Board.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER FISHER, the Court unanimously approved the purchase of items listed above, and to approve the County Auditor to auction the two Mack Tractor Units. . 



  6. Agenda #2e - Cleveland Asphalt

    • MINUTE ORDER #279/06:   County Engineer, Richard Macchi, presented for consideration the extension of contract with Cleveland Asphalt for the conversion of asphalt millings into cold mix at a renegotiated price of $19.50 per ton.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER FISHER, the Court unanimously approved this matter. 



  7. Agenda #2f - Letter of Credit No. 424

    • MINUTE ORDER #280/06:  County Engineer, Richard Macchi, presented for consideration the release of Letter of Credit No. 424, First State Bank, in the amount of $25,000.00 for the Tera Bella Subdivision.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER LANGE, the Court unanimously approved this matter.



  8. Agenda #2g - Plat for Rangers Promise

    • MINUTE ORDER #281/06:  County Engineer, Richard Macchi, presented the final plat for Rangers Promise, a 37-Lot, 2 Block, 2230 Acre Subdivision off Rose Lane in Precinct 2.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER LANGE, the Court unanimously approved the Final Plat for Rangers Promise. 



  9. Agenda #2h - Plat for Mesa Verde Phase 2

    • MINUTE ORDER #282/06:  County Engineer Richard Macchi, presented the Plat for Mesa Verde Phase 2, a 1-Lot, 1 Block, 3.059 Acre Subdivision off Tally Hoe & FM 2484 in Precinct 4 for final approval.  After due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER BROWN, the Court unanimously approved this matter.



  10. Agenda #3 - Personnel

    • MINUTE ORDER #283/06:  Upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved all employee status report forms, the same being attached hereto and made a part of these minutes.  



  11. Agenda #4 - Employee Health and Dental Insurance

    • MINUTE ORDER #284/06:  Ron Heuss, Director of Human Resources, presented for consideration the employee health an dental insurance for FY 2007.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved this matter, of which a copy is attached and made part of these minutes. 



  12. Agenda #5 - Appointment of Election Judges and Alternate Judges

    • MINUTE ORDER #285/06:  Lindsay Clark, Election Clerk, presented the Court with a list of Election Judges and Alternate Judges as recommended by the Republican and Democrat Parties.  After due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER LANGE, the Court unanimously approved this matter. 



  13. Agenda #6 - Memorandum of Understanding

    • MINUTE ORDER #286/06:  Tom Kozeny of the Juvenile Probation Office presented for approval a Memorandum of Understanding with Killeen Independent School District for the Juvenile Justice Alternative Education Program (JJAEP).  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved this matter.


  14. Agenda #7 - Memorandum of Understanding

    • MINUTE ORDER #287/06:    Tom Kozeny of the Juvenile Probation Office presented for approval a Memorandum of Understanding with Killeen Independent School District for the Residential Program for the Juvenile Detention Center.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved this matter. 



  15. Agenda #8 - Change Order Request

    • MINUTE ORDER #288/06:  After due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER CORTESE, with COMMISSIONER BROWN opposing, the Court agreed 4-1 with approval of Change Order Request 019 with CSS, Inc. regarding changes to the Justice of the Peace areas of Building 1 of the Bell County Annex in Killeen per Scope of work dated May 26, 2006. 


  16. Agenda #9 - Construction Manager-at-Risk Services

    • MINUTE ORDER #289/06:  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER FISHER, the Court unanimously approved for the County Auditor to advertise for request for qualifications for Construction Manager-at-Risk services for the construction and equipping of jail addition and jail facilities.  


  17. Agenda #10 - Claims

    • MINUTE ORDER #290/06:   Judge Jon H. Burrows, presented the claims for review to the Court.  After proper review, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved all such claims.  All according to a copy of the same being of record in the office of the County Auditor.  


               (The Court then went into workshop session to discuss those items on the workshop agenda with
                 no action being taken on any item.)



                There being no further business, the meeting adjourned.
