AFTER proper posting of public notice, a copy of which is attached hereto, on this the 14th day of August, 2006, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #310/06:  It being nine a.m., Judge Jon H. Burrows, called the regular meeting of the Commissioners' Court to order and called to the Courts attention that they had received the minutes of July 31, 2006.  After due discussion, the minutes were approved as presented. 
               



  2. Agenda #2 - Donation from City of Belton TIRZ

    • MINUTE ORDER #311/06:  Judge Burrows, presented the matter of receiving $100,000.00 donation from the City of Belton Tax Increment Reinvestment Zone (TIRZ) for the Bell County Museum Addition.  Mayor Jim Covington from the City of Belton was present and presented Judge Burrows with a check in the amount of $100,000.00 from the City of Belton Tax Increment Reinvestment Zone (TIRZ).  Stephanie Turnham and Griff Lord were present and thanked the City of Belton and the Bell County Commissioners Court for their support.  



  3. Agenda #3a - Public Hearing on Traffic Control Devices

    • MINUTE ORDER #312/06:  Judge Burrows opened the public hearing regarding traffic control devices, such devices are to be installed as follows:  (1) Install STOP sign at the intersection of Pecan School Road at Round Hall Road;  (2) Install STOP sign at the intersection of Swedish Lane at Oakalla Road;  (3) Install STOP sign at the intersection of Needle Point Lane at Oakalla Road;  (4) Install STOP sign at the intersection of English Lane at Oakalla Road;  (5) Install YIELD sign at the intersection of Moody Road at Willow Grove Road;  (6) Install 30 MPH speed limit on Troy View Drive;  (7) Install 30 MPH speed limit on Hill Country Drive;  (8) Install 30 MPH speed limit on that portion of Dog Ridge Road on the south side of U.S. 190;  (9) Install 40 MPH speed limit on Forrester Road, from Boutwell Road to Witter Lane;  (10) Install 55 MPH speed limit on Wedel Cemetery Road from Shaw Road to F.M. 437.  Judge Burrows asked if there were any public comments; there being none, the public hearing was closed and thereafter, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER CORTESE, the Court unanimously approved the installation of the aforementioned traffic control devices.   



  4. Agenda #3b - Final Approval of Plat - Gardens Subdivision

    • MINUTE ORDER #313/06:  County Engineer, Richard Macchi presented the matter to consider final approval of the Plat for the Gardens Subdivision, a Two-Lot, 6.915 acre subdivision in the E.T.J. of The Village of Salado.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved this matter. 



  5. Agenda #3c - Final Approval of Plat - High Crest Phase I 

    • MINUTE ORDER #314/06:  County Engineer, Richard Macchi presented the matter to consider final approval of the Plat for High Crest Phase I, a 68-Lot, 43.79 acre subdivision on F.M. 439 and acceptance of Letter of Credit No. 06-460 in the amount of $17,759.70 for the maintenance of streets.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved this matter. 



  6. Agenda #3d - Final Approval of Plat - Liberty Oaks

    • MINUTE ORDER #315/06:  County Engineer, Richard Macchi presented the matter to consider final approval of the Plat for Liberty Oaks Tract 2, a 3-Lot, 31.36 acre tract on Sparta Road, in the E.T.J. of the City of Temple.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved this matter. 



  7. Agenda #3e - Final Approval - LHR Estates

    • MINUTE ORDER #316/06:  County Engineer, Richard Macchi presented the matter to consider final approval of LHR Estates, a Six-Tract, 18.79 acre subdivision off of F.M. 2484, in the E.T.J. of the City of Killeen.  After due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER LANGE, the Court unanimously approved this matter.



  8. Agenda #3f - Final Approval of Plat - Wells Ranch Phase 4

    • MINUTE ORDER #317/06:  County Engineer, Richard Macchi presented the matter to consider final plat approval of Wells Ranch Phase 4, a 92-Lot, 92.695 acre Development in the E.T.J. of the City of Copperas Cove and acceptance of Letter of Credit No. 672, in the amount of $42,367.00 (First National Bank Texas) as warranty for the road and drainage improvements.  After due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER CORTESE, the Court unanimously approved this matter.  



  9. Agenda #4 - Personnel

    • MINUTE ORDER #318/06:  Upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER LANGE, the Court unanimously approved all employee status report forms, the same being attached hereto and made a part of these minutes.  



  10. Agenda #5 - Collections Contract

    • MINUTE ORDER #319/06:  Judge Burrows presented the matter to consider approval of the collection contract with law firm of Linebarger, Goggan, Blair & Sampson, LLP. in Austin and approval of collection contract with OMNI.  Mr. Kevin Chester from Linebarger, Goggan, Blair & Sampson, LLP was present.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER FISHER, the Court unanimously approved the collection contract with OMNI and the collection contract with the law firm of Linebarger, Goggan, Blair & Sampson, LLP. with the modifications to the contract, with the effective date of August 14, 2006 for 2 years with 60 days to terminate otherwise contract will automatically extend for 1 year period and there will be no fee to the county for unadjudicated cases prior to July 2003. 


  11. Agenda #6 - Contract with Attorney General of Texas

    • MINUTE ORDER #320/06:  Judge Burrows presented the matter to consider approval of Contract No.. 07-C0011 between Bell County and the Attorney General of Texas to furnish Registry Only court order information relating to Protective Orders and Family Violence under the Texas Family Code for use in the State and Federal Case Registries and local handling of inquires on and receiving information about Child Support Cases where child support payments are remitted to the Texas Child Support State Disbursement Unit (SDU), beginning September 1, 2006 through August 31, 2008.  Shelia Norman, Bell County District Clerk was present.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved this matter. 



  12. Agenda #7 - Report on County Indigent Health Care Program

    • MINUTE ORDER #321/06:  Judge Burrows presented the matter of receiving a report on County Indigent Health Care Program (CIHCP) for the period of September 1, 2005 through July 31, 2006.  Rita Kelley, Director of Bell County Health Services gave the Court an update.  (A copy of such update is attached hereto and made a part of these minutes).  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved the report. 



  13. Agenda #8 - Approval of Continued Administration of CIHCP

    • MINUTE ORDER #322/06:  Judge Burrows presented the matter to consider approval of the continued administration of the CIHCP according to the policies described in the Department of State Health Service's County Indigent Care Program Handbook.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER LANGE, the Court unanimously approved this matter.



  14. Agenda #9 - Approval of Inclusion of Optional CIHCP

    • MINUTE ORDER #323/06:  Judge Burrows presented the matter to consider approval of the inclusion of Optional CIHCP services during the State 2007 FY.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved this matter.  



  15. Agenda #10 - Update on Statewide Indigent Health Care Advisory Committee

    • MINUTE ORDER #324/06:  Judge Burrows presented the matter to consider update on the Statewide Indigent Health Care Advisory Committee and other statewide initiatives impacting CIHCP.  Rita Kelley, Director of Bell County Health Services gave the Court an update.  A copy of an email from the State Advisory Committee with proposed recommendations is attached hereto.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved the update received.   



  16. Agenda #11 - Amendment for Costs - Juvenile Detention Center

    • MINUTE ORDER #325/06:  Judge Burrows presented the matter to consider budget amendment for the costs of running the Juvenile Detention Center starting April 27, 2006.  Judge Burrows reported that the total net increase of the budget amendment is $603,500.00.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved this matter.   



  17. Agenda #12 - Dates for Public Hearings, Presentation/Approval of Budget & Tax Rates

    • MINUTE ORDER #326/06:  Judge Burrows presented the matter to consider setting dates for presentation of the budget, public hearings, and approval of the budget and tax rates, and consider approval of proposed tax rates for notice of public hearing purposes.  The following dates were set, with all meetings to be in the Commissioners Courtroom:  August 28, 2006 at 9:00 a.m., for presentation of the budget and the Public Hearing on the Budget and the first Public Hearing on the proposed Tax Rates;  September 1, 2006 at 9:00 a.m., for second Public Hearing on the proposed Tax Rates; and September 11, 2006 to adopt the FY 2006-2007 Budget and Tax Rates.  The proposed Tax Rates for notice of public hearing purposes was presented as $0.3815 per $100 valuation for Bell County General Fund and $0.0295 per $100 valuation for Bell County Road District, for a total of $0.4110 per $100 valuation.  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously approved the adoption of the proposed tax rates, the proposed dates for presentation and approval of the budget and tax rates, and the proposed dates for the public hearings.   



  18. Agenda #13 - Claims

    • MINUTE ORDER #327/06:   The County Auditor presented all claims for the review of the Court.  After proper review, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved all such claims.  All according to a copy of the same being of record in the office of the County Auditor.  



      There being no further business, the meeting adjourned.


               (The Court then went into workshop session to discuss those items on the workshop agenda with
                 no action being taken on any item.)
