AFTER proper posting of public notice, a copy of which is attached hereto, on this the 18th day of September, 2006, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #387/06:  Judge Jon H. Burrows, called to the Courts attention the fact that they had received the minutes of September 11, 2006.  After due discussion, the minutes were approved as submitted.



  2. Agenda #2a - Public Hearing for Traffic Control Devices

    • MINUTE ORDER #388/06:  Richard Macchi, County Engineer, presented the following traffic control devices for approval:
      1.  Install 30 MPH speed limit on Hester Way from Grandview Drive to Winner's Circle.
      2.  Install 35 MPH speed limit on Tem-Bel Lane.
      3.  Install 40 MPH speed limit on Armstrong Road from F.M. 1123 to Salado Creek.
      4.  Install "No Parking" signs on Chaparral Road at the bridge over Trimmier Creek.
      Judge Jon H. Burrows opened the above items for public hearing, with no public present to speak, the public hearing was closed.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved the above mentioned traffic devices.          



  3. Agenda #2b - Reconstruction of Little Flock Road

    • MINUTE ORDER #389/06:  Richard Macchi, County Engineer, presented for approval to add the reconstruction of 3,200 feet of Little Flock Road to the Annual Work Plan.  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously approved this matter.



  4. Agenda #2c - Plat for Whiteside Subdivision

    • MINUTE ORDER #390/06:  Richard Macchi, County Engineer, presented for approval the final plat for Whiteside Subdivision, a two-lot, 15.01 acre Subdivision in the E.T.J. of the City of Belton.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved this plat.



  5. Agenda #3 - Personnel

    • MINUTE ORDER #391/06:  Upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER BROWN, the Court unanimously approved all employee status report forms, the same being attached hereto and made a part of these minutes.  



  6. Agenda #4 - Shaken Baby Syndrome

    • MINUTE ORDER #392/06:  Judge Jon H. Burrows, read the Proclamation designating September as Shaken Baby Syndrome and Child Safety Awareness Month in Bell County.  After due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER BROWN, the Court unanimously approved this Proclamation. 


       
  7. Agenda #5 - Appointment of Marlene DiLillo

    • MINUTE ORDER #393/06:  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved the appointment of Marlene DiLillo, Director of the Greater Killeen Free Clinic, to fill a vacancy on the Board of Hill Country Community Action Association, Inc.


  8. Agenda #6 - Burn Ban

    • MINUTE ORDER #394/06:  Steve Casey, Bell County Fire Marshall, presented the Burn Ban for consideration of being lifted.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER FISHER, the Court unanimously approved to immediately lift the Burn Ban.  



  9. Agenda #7 - 2007 Sheriff's Fees, Constables Fees, and other Fees

    • MINUTE ORDER #395/06:  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously approved the 2007 Sheriff, Constable, and other Fees.



  10. Agenda #8 - Animal Shelter Services

    • MINUTE ORDER #396/06:   After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved the Interlocal Agreement between Bell County, Texas and the City of Belton, Texas allowing the City of Belton to operate under Bell County's Contract for Services with Dr. Warren Dunn dba Bell Area Animal Shelter, LLC for animal services.



  11. Agenda #9 - Texas County & District Retirement System

    • MINUTE ORDER #397/06:  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved the continuation of current plan provisions under Texas County & District Retirement System with no changes for plan year 2007 for Bell County, County #113, and adoption of contribution rate of 10.39%.



  12. Agenda #10 - Change Order No 5

    • MINUTE ORDER #398/06:  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER FISHER, the Court unanimously approved change order number 5 with CSS, Inc. for Bell County Killeen Annex Renovations for Tax Appraisal District area and other revisions.



  13. Agenda #11 - Software Maintenance Service Contract

    • MINUTE ORDER #399/06:  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved the renewal of Software Maintenance Service Contract for October 1, 2006 through September 30, 2008 with Intergraph Corporation for the Bell County Communications Center.



  14. Agenda #12 - Lone Star Legal Aid

    • MINUTE ORDER #400/06:  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved the renewal of Memorandum of Understanding with Lone Star Legal Aid regarding Protective Orders.   



  15. Agenda #13 - Lone Star Legal Aid

    • MINUTE ORDER #401/06:  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved the renewal of Memorandum of Understanding with Lone Star Legal Aid regarding Pro Se Assistance Program for family law cases.



  16. Agenda #14 - Lone Star Legal Aid

    • MINUTE ORDER #402/06:  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved the renewal of Memorandum of Understanding with Lone Star Legal Aid regarding Lawyer Magistrate Services for the Juvenile Court.



  17. Agenda #15 - Transportation of Bodies

    • MINUTE ORDER #403/06:   After due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER BROWN, the Court unanimously approved for the County Auditor to advertise for bids for the Transportation of Bodies for Autopsies and First Call Services.



  18. Agenda #16 - Awarding of Bid for Installation and Termination of Fiber

    • MINUTE ORDER #404/06:  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER BROWN, the Court unanimously approved to award the bid for the Installation and Termination of fiber at 200 W. Avenue G in Temple, to JC Communications.  



  19. Agenda #17 - Security Camera System

    • MINUTE ORDER #405/06:  After due discussion, upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER BROWN, the Court unanimously approved for the County Auditor to advertise for bids for a Security Camera System for the Juvenile Detention Center.



  20. Agenda #18 - Jamail Construction

    • MINUTE ORDER #406/06:  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER BROWN, the Court unanimously approved for the County Auditor to initiate contact with Jamail Construction, via the BuyBoard, for the purpose of obtaining quotes for remodeling projects at the County Extension Office and the Road & Bridge Personnel Office.  



  21. Agenda #19 - Replacement Vehicle

    • MINUTE ORDER #407/06:  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER FISHER, the Court unanimously approved for the County Auditor to procure a replacement vehicle for Juvenile Probation by either sealed bid or through a cooperative purchasing program.



  22. Agenda #20 - FY 2006-2007 County Auditor's Budget

    • MINUTE ORDER #408/06:  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved the annual order certifying the FY 2006-2007 County Auditor's Budget.   



  23. Agenda #21 - Court Reporter Pay

    • MINUTE ORDER #409/06:  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved the Order from District Judges concerning Court Reporter Pay.  



  24. Agenda #22 - Claims

    • MINUTE ORDER #410/06:  Judge Jon H. Burrows, presented the claims for review to the Court.  After proper review, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved all such claims.  All according to a copy of the same being of record in the office of the County Auditor. 



      (The Court then went into workshop session to discuss those items on the workshop agenda with no action being taken on any item.)


                There being no further business, the meeting adjourned.
