AFTER proper posting of public notice, a copy of which is attached hereto, on this the 25th day of September, 2006, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #411/06:  Judge Jon H. Burrows, called to the Courts attention the fact that they had received the minutes of September 18, 2006.  After due discussion, the minutes were approved as submitted.



  2. Agenda #2a - Hot Mix Asphaltic Concrete

    • MINUTE ORDER #412/06:  Richard Macchi, County Engineer, presented for approval the adjustment to the contract price that is being paid or hot mix asphaltic concrete.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved to adjust the prices.          



  3. Agenda #2b - Liberty Oaks, Phase II Subdivision

    • MINUTE ORDER #413/06:  Richard Macchi, County Engineer, presented for approval to release cashier's check in the amount of $15,115.00, Security State Bank & Trust, and accept in it's place an amendment of Letter of Credit No. NZS552842, Wells Fargo Bank, extending the expiration date to September 15, 2007 and changing the amount to $15,115.00 for proposed improvements in Liberty Oaks, Phase II, Subdivision.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER FISHER, the Court unanimously approved this matter.



  4. Agenda #2c - Advertise for Bids

    • MINUTE ORDER #414/06:  Richard Macchi, County Engineer, presented for approval to advertise for bids for the annual purchase of aggregate, culverts, reinforcing steel, and base.  After due discussion, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER LANGE, the Court unanimously approved to advertise for bids. 



  5. Agenda #2d - Set Public Hearing Date

    • MINUTE ORDER #415/06:  Richard Macchi, County Engineer, presented for approval to set a Public Hearing for the abandonment/vacation of approximately 0.084 acres of Right of Way on West Drive, Lakewood Terrace Subdivision.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved to set the public hearing date as October 23, 2006 at 9:00 a.m. in the Commissioner's Court Room.  



  6. Agenda #3 - Personnel

    • MINUTE ORDER #416/06:  Upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER CORTESE, the Court unanimously approved all employee status report forms, the same being attached hereto and made a part of these minutes.  



  7. Agenda #4 - Burn Ban

    • MINUTE ORDER #417/06:  Steve Casey, Bell County Fire Marshall presented the current statistics of the burn ban.  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously approved to reinstate the Burn Ban, effective immediately and to continue for 30 days.  


       
  8. Agenda #5 - Interlocal Assistance Agreement

    • MINUTE ORDER #418/06:  Sheriff Dan Smith, presented for approval the Interlocal Assistance Agreement - Region Auto Theft Enforcement Task Force between Bell County and the Counties of Austin, Bastrop, Blanco, Burnet, Caldwell, Colorado, Comal, Fayette, Guadalupe, Hays, Lee, Llano, Milam, Travis, Wharton, and Williamson, with Travis County acting as Manager for administration.  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously approved this matter.


  9. Agenda #6 - EDAC System Maintenance Agreement

    • MINUTE ORDER #419/06:  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER FISHER, the Court unanimously approved the annual contract renewal of EDAC System Maintenance Agreement for October 1, 2006 through September 30, 2007 with M/A-Com Inc. for the Bell County Communications Center.   



  10. Agenda #7 - County Holidays

    • MINUTE ORDER #420/06:  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously approved the CY 2007 Holiday Schedule. 



  11. Agenda #8 - Sick Leave Policy

    • MINUTE ORDER #421/06:   After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved the modification to the Sick Leave Policy to 960 sick hours.



  12. Agenda #9 - Czech Heritage Month

    • MINUTE ORDER #422/06:  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER CORTESE, the Court unanimously approved the Proclamation designating October as Czech Heritage Month in Bell County.



  13. Agenda #10 - Claims

    • MINUTE ORDER #423/06:  Judge Jon H. Burrows, presented the claims for review to the Court.  After proper review, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved all such claims.  All according to a copy of the same being of record in the office of the County Auditor. 



      (The Court then went into workshop session to discuss those items on the workshop agenda with no action being taken on any item.)


                There being no further business, the meeting adjourned.
