AFTER proper posting of public notice, a copy of which is attached hereto, on this the 23rd day of October, 2006, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #456/06:  Judge Jon H. Burrows, called to the Courts attention the fact that they had received the minutes of October 16, 2006.  After due discussion, the minutes were approved as submitted.



  2. Agenda #2a - Vacation/Abandonment of West Drive

    • MINUTE ORDER #457/06:  Tom Berrier, Assistant County Engineer presented for approval the vacation/abandonment of approximately 0.084 acres of West Drive, Lakewood Terrace Subdivision.  Judge Jon H. Burrows opened the public hearing on this matter, with no public comments, the public hearing was closed.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved the vacation/abandonment of 0.084 acres of West Drive.           



  3. Agenda #2b - Plat for W.S. Hawkins Addition

    • MINUTE ORDER #458/06:  Tom Berrier, Assistant County Engineer presented for approval the plat for W.S. Hawkins Addition, a two-lot, 3.63 Acre Subdivision in the E.T.J. of the City of Belton, fronting onto F.M. 436.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER LANGE, the Court unanimously approved this matter.



  4. Agenda #2c - Plat for Shiloh Terrace

    • MINUTE ORDER #459/06:  Tom Berrier, Assistant County Engineer presented for approval the plat for Shiloh Terrace, Phase 3, a 35-Lot, 26.158 Acre Development in the E.T.J. of the City of Temple.  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved this matter.



  5. Agenda #2d - Plat for Chisholm Oaks

    • MINUTE ORDER #460/06:  Tom Berrier, Assistant County Engineer presented for approval the plat for Chisholm Oaks, a 12-Lot, 24.686 Acre Development in Precinct 3.  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER BROWN, the Court unanimously approved this matter.



  6. Agenda #2e - Annual Bids

    • MINUTE ORDER #461/06:  After due discussion, upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved to award the bid for reinforcing steel to CMC Alamo Steel.
              Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER FISHER, the Court unanimously approved to award the bids for Crushed Limestone to all who bid; Miller Springs Materials, Killeen Crushed Stone, Franklin Industries, Mine Services, Shallowford Construction, and Clayton Aggregates.
              Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved to award the bid for Culverts to Contech.
              Upon motion of COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved to award the bid for crushed stone/gravel to Killeen Crushed Stone, for Light Weight, to TXI and the bid for washed gravel to none of the bidders.



  7. Agenda #3 - Personnel

    • MINUTE ORDER #462/06:  Upon motion of COMMISSIONER FISHER, seconded by COMMISSIONER LANGE, the Court unanimously approved all employee status report forms, the same being attached hereto and made a part of these minutes.



  8. Agenda #4 - Burn Ban

    • MINUTE ORDER #462/06:  No action was taken and this item was passed at this time.  



  9. Agenda #5 - Homeland Security Funds

    • MINUTE ORDER #463/06:  After explanation by Jim Reed, Executive Director of CTCOG and after due discussion, upon motion by COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved opting out of participating with the State in use of Homeland Security Funds for State-wide local projects.



  10. Agenda #6 - Advertise for Bids

    • MINUTE ORDER #464/06:  After due discussion, upon motion of COMMISSIONER LANGE, seconded by COMMISSIONER FISHER, the Court unanimously approved for the Auditors Office to advertise for bids for vending services for county facilities.



  11. Agenda #7 - First Southwest Company Presentation

    • MINUTE ORDER #465/06:  Gary Kimball of First Southwest Company, made a presentation of Sufficiency Letter pertaining to Scott & White Series 2006 Financing. 



  12. Agenda #8 - First Southwest Company

    • MINUTE ORDER #466/06:  After due discussion, upon motion by COMMISSIONER BROWN, seconded by COMMISSIONER FISHER, the Court unanimously approved a Resolution Accepting Report of First Southwest Company Pertaining to the Issuance of Bonds; and Providing an Effective Date, a copy of which is attached to these minutes.


      [The Court recessed to allow the Court to convene as the Board of Bell County Health Facilities Development Corporation to take action on the Scott & White Series 2006 Financing, and the Court reconvened after that Board took action.]



  13. Agenda #9 - Issuance of Bonds

    • MINUTE ORDER #467/06:  After due discussion, upon motion by COMMISSIONER CORTESE, seconded by COMMISSIONER BROWN, the Court unanimously approved an Order Approving the Issuance of Bonds by the Bell County Health Facilities Development Corporation to Finance the Cost of Health Facilities for Scott & White Memorial Hospital and Scott, Sherwood and Brindley Foundation and With Respect to a Public Hearing, a copy of which is attached to these minutes.



  14. Agenda #10 - Claims

    • MINUTE ORDER #468/06:  Judge Jon H. Burrows presented the claims for review to the Court.  After proper review, upon motion of COMMISSIONER BROWN, seconded by COMMISSIONER CORTESE, the Court unanimously approved all such claims.  All according to a copy of the same being of record in the office of the County Auditor. 




                There being no further business, the meeting adjourned.
