- MINUTE ORDER #076/07: It being nine a.m., Judge
Jon H. Burrows called the regular meeting of the Commissioners' Court to
order and called to the Courts attention that the minutes of February 12,
2007, had been received. After due discussion, these minutes were
approved as presented.
Agenda #2a - South Mockingbird Road
- MINUTE ORDER #077/07: Judge Jon H. Burrows
opened
the public hearing regarding the abandonment/vacation of a portion of South
Mockingbird Road. There being no public comment, after due discussion, upon motion by
Commissioner Eddy Lange, second by Commissioner Richard Cortese, the
Court unanimously approved this matter.
Agenda #2b - Right of Way/Drainage Easement - Huey
Road
- MINUTE ORDER #078/07: County Engineer Richard
Macchi presented for approval the matter of deeding a Right-of-Way
and granting a Drainage Easement to the City of Belton for the planned
extension of Huey Road. After due discussion, upon motion by Commissioner
Richard Cortese, second by Commissioner Tim Brown, the Court
unanimously approved this matter.
Agenda #2c - Chisholm Oaks Subdivision
- MINUTE ORDER #079/07: County Engineer
Richard Macchi presented for approve the Final Plat for the Replat of
Lots 1, 2, and 3, Chisholm Oaks Subdivision. After due discussion, upon motion by Commissioner
Eddy Lange, second by Commissioner Tim Brown, the Court unanimously approved
this matter.
Agenda #2d - Ryan Addition
- MINUTE ORDER #080/07: County Engineer Richard
Macchi presented for approval the releasing of Cashier's Check No.
197715. First State Bank Central Texas, in the amount of $1,750.00 now being
held as warranty for defects in the street improvements of Ryan Addition. After due discussion, upon motion by
Commissioner Tim Brown, second by Commissioner John Fisher, the Court
unanimously approved this matter.
Agenda #2e - Awarding of various bids for materials
- MINUTE ORDER #081/07: County Engineer Richard
Macchi presented for approval the matter of awarding bids for the
following materials:
Liquid Asphalt: After due discussion, upon motion by Commissioner
Richard Cortese, second by Commissioner Eddy Lange, the Court unanimously awarded
the bid for liquid asphalt to Sem Materials at a cost of $1.6456 per gallon
for AE-P and $1.2256 per gallon for HFRS-2.
Hot Mix Asphalt: After due discussion, upon motion by
Commissioner John Fisher, second by Commissioner Eddy Lange, the Court unanimously awarded
the bid for hot mix asphalt to Central Texas Asphalt in Youngsport at $45.00
per ton, Wheeler Coatings in Kempner at $44.00 per ton, and Austin Bridge &
Road in Belton at $45.00 per ton.
Cold Mix Asphalt: After due discussion, upon motion by
Commissioner Richard Cortese, second by Commissioner John Fisher, the Court unanimously awarded
the bid for cold mix asphalt to Vulcan Materials in Uvalde, as primary
provider at $46.56 per ton, and Austin Bridge in Belton, as secondary
provider, $55.00 per ton.
Lime: After due discussion, upon motion by Commissioner Eddy Lange, second by
Commissioner John Fisher, the Court unanimously awarded the bid for lime
to Austin White Lime in the amount of $91.11 per ton.
Cement: After due discussion, upon motion by Commissioner Richard
Cortese, second by Commissioner Eddy Lange, the Court unanimously awarded
the bid for cement to Capital Cement in San Antonio in the amount of $116.45
per ton, delivered.
Concrete: After due discussion, upon motion by Commissioner John
Fisher, second by Commissioner Richard Cortese, the Court unanimously awarded
the bid for concrete to both Belcrete in Belton and Killeen Ready
Mix/Pro-Mix in Killeen.
Pit-run Gravel: After due discussion, upon motion by Commissioner
Tim Brown, second by Commissioner John Fisher, the one bid
received was rejected and this matter opened for re-bid.
Agenda #3 - Personnel
- MINUTE ORDER #082/07: Upon motion of
Commissioner John Fisher, second by Commissioner Eddy Lange, the Court unanimously approved all employee status report forms,
the same being attached hereto and made a part of these minutes.
Agenda #4 - HJR 61 - Unfunded County Mandates
- MINUTE ORDER #083/07: Upon motion by
Commissioner Tim Brown, second by Commissioner John Fisher, the Court unanimously approved
the passing of a Resolution asking the Texas Legislature to pass HJR 61, by
Chairman Wayne Smith, prohibiting unfunded County mandates unless the State
provides to the County the costs of the mandate and that a constitution
prohibition on unfunded mandates be supported, noting that the Conference of
Urban Counties has identified at least 31 bills containing unfunded mandates
have already been filed.
Agenda #5 and #6 - Expo Master Plan
- MINUTE ORDER #084/07: After due discussion,
upon motion by
Commissioner John Fisher, second by Commissioner Richard Cortese,
the Court unanimously approved to receive a Resolution unanimously passed by
the Board of Directors of Bell County Expo, Inc. endorsing the approximately
15 million dollar Expo Master Plan and urging the Bell County Commissioners
Court to pursue the County Hotel Occupancy Tax option to fund the new
facility; and approved February 26, 2007, at 6:30 p.m. at the Bell County
Expo Center, Special Events Meeting Room, Belton, Texas, for a presentation
and Public Hearing on the Expo Master Plan and the Expo Center Boards'
request that a County Hotel Occupancy Tax be used to fund the project and to
consider action on the request.
Agenda #7 - Collection Guidelines for Court Costs
and Fees
- MINUTE ORDER #085/07: After presentation by
Susan Weaver with the Bell County Auditor's Office, Judge Jon Burrows
presented for approval the Collection Guidelines for Court Costs and Fees in
response to Senate Bill 1863 and guidance from the Office of Court
Administration. After due discussion, upon motion by
Commissioner Eddy Lange, second by Commissioner Tim Brown, the Court unanimously approved
this matter.
Agenda #8 - Indigent Defense
- MINUTE ORDER #086/07: Judge Jon Burrows
presented for approval the submission of application for Discretionary Grant
from the Task Force for Indigent Defense. After due discussion,
upon motion by
Commissioner Richard Cortese, second by Commissioner Eddy Lange,
the Court unanimously approved this matter.
Agenda #9 - Notice to Proceed
- MINUTE ORDER #087/07: Judge Jon Burrows
presented for approval and ratification the authorization of Notice to
Proceed to Skanska USA Building, Inc. to begin construction of the Bell
County Jail Addition. After due discussion, upon motion by
Commissioner Richard Cortese, second by Commissioner Tim Brown, the Court unanimously approved
this matter.
Agenda #10 - Agreement with Wiginton Hooker Jeffry,
P.C.
- MINUTE ORDER #088/07: Judge Jon Burrows
presented for approval and Ratification of Amendment No. 5 to Agreement
between Owner and Architect dated February 8, 2003 with Wiginton Hooker
Jeffry, P.C. regarding the new Bell County Jail Addition project.
After due discussion, upon motion by
Commissioner Tim Brown, second by Commissioner Richard Cortese,
the Court unanimously approved this matter.
Agenda #11 - Claims
- MINUTE ORDER #089/07: Judge Jon Burrows presented the
claims for review to the Court. After proper review, upon motion
of Commissioner Tim Brown, seconded by Commissioner Richard Cortese,
the Court unanimously approved all such claims. All according to a
copy of the same being of record in the office of the County Auditor.
(The Court then went into workshop session to discuss those items on the
workshop agenda with no action being taken on any item.)
There being no further business, the meeting
adjourned.
