AFTER proper posting of public notice, a copy of which is attached hereto, on this the 10th day of September, 2007, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #358/07:  It being nine a.m., Judge Jon Burrows called the regular meeting of the Commissioners' Court to order and called to the Courts attention that the minutes of August 27, 2007 regular session had been received.  After due discussion, these minutes were approved as presented.



  2. Agenda #2a - County Engineer

    • MINUTE ORDER #359/07:  County Engineer Richard Macchi presented for approval the installation of the following traffic control devices:
      1.  Install YIELD sign on Allena Lane at Frederick Lane (Woods of Cedar Oaks);
      2.  Install 30 MPH speed limit on Deer Run, Creek Place Subdivision.
      County Engineer Richard Macchi announced that the notice of the public hearing was posted in the Temple Daily Telegram on August 19, 2007 and no public comments were received.  County Judge Jon Burrows opened the public hearing at 9:07 a.m.  With no public comments being made, the hearing was closed.  After due discussion, upon motion by Commissioner John Fisher, second by Commissioner Eddy Lange, the Court unanimously approved this matter.   



  3. Agenda #2b - Prices for Hot Mix Asphalt and Liquid Asphalt

    • MINUTE ORDER #360/07:  County Engineer Richard Macchi presented for approval the adjustment to the prices for hot mix asphalt and liquid asphalt.  After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner Eddy Lange, the Court unanimously approved this matter.   



  4. Agenda #2c - Letter of Credit No. 672 - Wells Ranch Phase IV

    • MINUTE ORDER #361/07:  County Engineer Richard Macchi presented for approval releasing Letter of Credit #672 in the amount $42,367.00 for Wells Ranch Phase IV in Precinct 4.  After due discussion, upon motion by Commissioner John Fisher, second by Commissioner Tim Brown, the Court unanimously approved this matter.    



  5. Agenda #3 - Personnel

    • MINUTE ORDER #362/07:   Upon motion of Commissioner Tim Brown, second by Commissioner Richard Cortese, the Court unanimously approved all employee status report forms with approved budget amendment, the same being attached hereto and made a part of these minutes.



  6. Agenda #4 - Tax Appraisal District of Bell County Board Representative

    • MINUTE ORDER #363/07:   County Judge Jon Burrows presented for approval the re-appointment of Bill Holmes of Belton as Bell County's representative on the 7-member board of the Tax Appraisal District of Bell County for a two-year term beginning January 1, 2008.  After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner Tim Brown, the Court unanimously approved this matter.




  7. Agenda #5 - Shaken Baby Syndrome and Child Safety Awareness Month in Bell County

    • MINUTE ORDER #364/07:  Following presentation by Maureen Jouett, President-Elect of the Killeen Exchange  Club, County Judge Jon Burrows presented for approval a Proclamation designating September as Shaken Baby Syndrome and Child Safety Awareness Month in Bell County.  After due discussion, upon motion by Commissioner John Fisher and seconded by Commissioner Tim Brown,  the Court unanimously approved this matter.  A copy of said Proclamation is attached hereto and made part of these minutes.




  8. Agenda #6 - Preparedness Month in Bell County

    • MINUTE ORDER #365/07:  County Judge Jon Burrows presented for approval a Proclamation designating September as Preparedness Month in Bell County and announced the Bell County Coalition of Disaster Preparedness event.  After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner Eddy Lange, the Court unanimously approved this matter.  A copy of said Proclamation is attached hereto and made part of these minutes.




  9. Agenda #7 - Memorandum of Understanding for Bell County Juvenile Justice Alternative Education Program (JJAEP)

    • MINUTE ORDER #366/07:   County Judge Jon Burrows presented for approval a Memorandum of Understanding between Bell County, the Bell County Juvenile Board and Juvenile Judge, and the Boards of Trustees of the Independent School Districts of Academy, Bartlett, Belton, Florence, Holland, Killeen Rogers, Salado, Troy, and Temple for the 2007-2008 school year operation and administration of the Bell County Juvenile Justice Alternative Education Program (JJAEP).  After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner Richard Cortese, the Court unanimously approved this matter.  A copy of said Memorandum is attached hereto and made part of these minutes. 




  10. Agenda #8 - Memorandum of Understanding for Educational Services at the Bell County Juvenile Detention Center

    • MINUTE ORDER #367/07:  After due discussion, upon motion by Commissioner John Fisher, second by Commissioner Tim Brown, the Court unanimously approved a Memorandum of Understanding between Bell County, the Bell County Juvenile Board and Juvenile Judge and the Board of Trustees of the Killeen Independent School District for the 2007-2008 School Year education services at the Bell County Juvenile Detention Center.  A copy of said Memorandum is attached hereto and made part of these minutes.




  11. Agenda #9 - Lone Star Legal Aid Memorandum of Understanding - Protective Orders

    • MINUTE ORDER #368/07:  After due discussion, upon motion by Commissioner Eddy Lange, second by Commissioner Richard Cortese, the Court unanimously approved the renewal of a Memorandum of Understanding with Lone Star Legal Aid regarding Protective Orders.  A copy of said Memorandum is attached hereto and made part of these minutes.




  12. Agenda #10 - Lone Star Legal Aid Memorandum of Understanding - Pro Se Assistance Program

    • MINUTE ORDER #369/07:  County Judge Jon Burrows presented for approval the renewal of a Memorandum of Understanding with Lone Star Legal Aid regarding Pro Se Assistance Program for family law cases.  After due discussion, upon motion by Commissioner Eddy Lange, second by Commissioner Tim Brown, the Court unanimously approved this matter.  A copy of said Memorandum is attached hereto and made part of these minutes.




  13. Agenda #11 - Lone Star Legal Aid Memorandum of Understanding - Lawyer Magistrate Services for the Juvenile Court

    • MINUTE ORDER #370/07:  After due discussion, upon motion by Commissioner Eddy Lange, second by Commissioner Tim Brown, the Court unanimously approved renewal of a Memorandum of Understanding with Lone Star Legal Aid regarding Lawyer Magistrate Services for the Juvenile Court.  A copy of said Memorandum is attached hereto and made part of these minutes. 




  14. Agenda #12 - 2008 Bell County Holiday Schedule

    • MINUTE ORDER #371/07:  Judge Jon Burrows presented for approval the 2008 Calendar Year Holiday Schedule.  After due discussion, upon motion by Commissioner John Fisher, second by Commissioner Richard Cortese, the Court unanimously approved this matter.  A copy of said schedule is attached and made part of these minutes.




  15. Agenda #13 - Change Order Number 002-Jail Addition Project

    • MINUTE ORDER #372/07:  After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner Richard Cortese, the Court unanimously approved Change Order Number 002 with Skanska USA Building, Inc. on the Jail Addition Project with no change in Guaranteed Maximum Price.  A copy of said Change Order is attached hereto and made part of these minutes.




  16. Agenda #14 - 2008 Sheriff's, Constables' and Other Fees

    • MINUTE ORDER #373/07:  After due discussion, upon motion by Commissioner John Fisher, second by Commissioner Eddy Lange, the Court unanimously approved the 2008 Sheriff's fees, Constables' fees and other fees for Bell County, a copy of which is attached hereto and made part of these minutes.




  17. Agenda #15 - Texas County & District Retirement System Plan Year 2008

    • MINUTE ORDER #374/07:  County Judge Jon Burrows presented for approval the Texas County & District Retirement System (TCDRS) plan provisions for Plan Year 2008 for Bell County, County #113, and adoption of annual contribution rate of 10.16%.  After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner Richard Cortese, the Court unanimously approved this matter.




  18. Agenda #16 - Bell County Flooding Damage and Disaster Assistance

    • MINUTE ORDER #375/07:  Dennis Baker, Director of Emergency Management Services for Bell County presented an update to the Court regarding Bell County Flooding Damage and Disaster Assistance status.  No action taken.




  19. Agenda #17 - Claims

    • MINUTE ORDER #376/07:  Judge Jon Burrows presented the claims for review to the Court.  After proper review, upon motion of Commissioner Tim Brown, second by Commissioner Richard Cortese, the Court unanimously approved all such claims.  All according to a copy of the same being of record in the office of the County Auditor.    



  20.         (The Court then went into workshop session to discuss those items on the workshop agenda with no action being
             taken on any item.)


             There being no further business, the meeting adjourned.
