AFTER proper posting of public notice, a copy of which is attached hereto, on this the 26th day of November, 2007, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #478/07:  It being nine a.m., Judge Jon Burrows called the regular meeting of the Commissioners' Court to order and called to the Courts attention that the minutes of November 19, 2007 regular session had been received.  After due discussion, these minutes were approved as presented.



  2. Agenda #2a - Public Hearing on Traffic Control Devices

    • MINUTE ORDER #479/07:  County Engineer Richard Macchi presented for approval the installation of the following Traffic Control Devices.  Notice of a Public Hearing to be held November 26, 2007 at 9:00 a.m. was posted in the Temple Daily Telegram on November 4, 2007 and November 18, 2007.  Judge Jon Burrows opened the public hearing at 9:06 a.m.  There being no public comments, the hearing was closed.  After due discussion, upon motion by Commissioner John Fisher, second by Commissioner Richard Cortese, the Court unanimously approved the installation of the following Traffic Control devices:
          1.  YIELD sign on Williams Road at West Village Road;
          2.  55 MPH speed limit on Brewer Road, from FM 2484 to 1.0 miles south;
          3.  55 MPH speed limit on Thomas Arnold Road from the south end of Brewer Road to 1.3 miles east;
          4.  40 MPH speed limit on Thomas Arnold Road from West Creek Road to 0.6 miles east and north.     



  3. Agenda #2b - Purchase of One Rubber Tire Loader and Four Backhoes

    • MINUTE ORDER #480/07:  After due discussion, upon motion by Commissioner Eddy Lange, second by Commissioner Richard Cortese, the Court unanimously approved authorizing County Engineer Richard Macchi to purchase off of the Buy Board one rubber tired loader and four backhoes.       



  4. Agenda #2c - Cooper Subdivision

    • MINUTE ORDER #481/07:  County Engineer Richard Macchi presented for approval the final plat for Cooper Subdivision, a One-Lot, One Acre Subdivision fronting on Krause Road, Precinct 2.  After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner Eddy Lange, the Court unanimously approved this matter.      



  5. Agenda #2d - Maddux Subdivision

    • MINUTE ORDER #482/07:  County Engineer Richard Macchi presented for approval the final plat for Maddux Subdivision, a Two-Lot, 10.34 Acre Subdivision in the E.T.J. of the City of Temple, fronting on Oscar Lane.  After due discussion, upon motion by Commissioner Eddy Lange, second by Commissioner Richard Cortese, the Court unanimously approved this matter.      



  6. Agenda #2e - Bids for Grade 4 and 5 Aggregate for the Seal Coat Program

    • MINUTE ORDER #483/07:  After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner John Fisher, the Court unanimously approved awarding the bids for Grade 4 and 5 Aggregate for the Seal Coat Program to all three bidders:  Capitol Aggregates in Fairland, Texas; Knife River in Lampasas, Texas, and TXI in Streetman, Texas.       



  7. Agenda #2f - D.J. Fuller Addition

    • MINUTE ORDER #484/07:  County Engineer Richard Macchi presented for approval the final plat for D.J. Fuller Addition, a 7-Lot, 4.153 Acre Development in the E.T.J. of the Village of Salado, fronting on Salado School Road.  After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner John Fisher, the Court unanimously approved this matter.      



  8. Agenda #3 - Personnel

    • MINUTE ORDER #485/07:   Upon motion by Commissioner Eddy Lange, second by Commissioner John Fisher, the Court unanimously approved all employee status report forms with approved budget amendment, the same being attached hereto and made a part of these minutes.



  9. Agenda #4 - Book Donation to Bell County Museum

    • MINUTE ORDER #486/07:   After due discussion, upon motion by Commissioner John Fisher, second by Commissioner Richard Cortese, the Court unanimously accepted a donation by John Galure to the Bell County Museum of a book on Chief Justice John Danley, his great grandfather.




  10. Agenda #5 - Purchase for use at Bell County Youth Fair and EXPO Center

    • MINUTE ORDER #487/07:   After due discussion, upon motion by Commissioner Eddy Lange, second by Commissioner Richard Cortese, the Court unanimously approved authorizing the purchase of panels, materials, and a skid-steer loader out of Bingo Proceeds for use at the Bell County Youth Fair and EXPO Center.



  11. Agenda #6 - Order Restricting Outdoor Burning

    • MINUTE ORDER #488/07:   Upon receipt of report from Fire Marshall Steve Casey, and motion by Commissioner Richard Cortese, second by Commissioner John Fisher, the Court unanimously lifted the Order Restricting Outdoor Burning temporarily for 72 hours effective at sunrise Tuesday, November 27, 2007 until sunset Thursday, November 29, 2007.  The Order will become effective again on Thursday, November 29, 2007, at sunset.



  12. Agenda #7 - Policy Committee of Conference of Urban Counties for 2008-2009

    • MINUTE ORDER #489/07:   After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner John Fisher, the Court unanimously approved the nomination of Judge Jon Burrows to serve on the Policy Committee of the Conference of Urban Counties for 2008-2009. 



  13. Agenda #8 - Federal Annual Certification Report for Central Texas Narcotics Task Force

    • MINUTE ORDER #490/07:   Bell County Auditor Donna Eakin presented for approval the Federal Annual Certification Report for the Central Texas Narcotics Task Force for the time period October 1, 2006 through September 30, 2007.  After due discussion, upon motion by Commissioner Eddy Lange, second by Commissioner Richard Cortese, the Court unanimously approved this report.  A copy of said report is attached hereto and made part of these minutes.



  14. Agenda #9 - Public Hearing Pursuant to Section 11.253 of the Texas Tax Code

    • MINUTE ORDER #491/07:   Judge Jon Burrows opened the public hearing at 9:37 a.m. on the adoption of an Order to continue to tax personal property in transit which would otherwise be exempt pursuant to new Section 11.253 of the Texas Tax Code.  There being no comments offered, the hearing was closed.



  15. Agenda #10 - Adoption of Order Pursuant to Section 11.253 of the Texas Tax Code

    • MINUTE ORDER #492/07:   After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner John Fisher, the Court unanimously approved an Order of Bell County to Tax Tangible Personal Property in Transit which would otherwise be exempt pursuant to Texas Tax Code, Section 11.253.



  16. Agenda #11 - Claims

    • MINUTE ORDER #493/07:   Judge Jon Burrows presented the claims for review to the Court.  After proper review, upon motion by Commissioner Richard Cortese, second by Commissioner John Fisher, the Court unanimously approved all such claims.  All according to a copy of the same being of record in the office of the County Auditor.



  17.         (The Court then went into workshop session to discuss those items on the workshop agenda with no action being
             taken on any item.)


             There being no further business, the meeting adjourned.
