AFTER proper posting of public notice, a copy of which is attached hereto, on this the 14th day of July, 2008, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #277/08:  County Judge Jon Burrows called to the Courts attention that the minutes of June 30, 2008, 9:00 a.m. regular session had been received.  After due discussion, these minutes were approved as presented.



  2. Agenda #2a - County Engineer

    • MINUTE ORDER #278/08:   Tom Berrier with the County Engineer's Office presented for approval releasing Letter of Credit No. 3597, Extraco Financial Group, in the amount of $4,178.35, for the maintenance of improvements on Marigold Trail and Moss Rose Trail.  After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner Richard Cortese, the Court unanimously approved this matter.
          


  3. Agenda #2b - Award Hot Mix Overlay Bid

    • MINUTE ORDER #279/08:    Tom Berrier with the County Engineer's Office presented the matter of awarding the bid for the hot mix overlay of a portion of Williams Road.  Bids opened on July 8, 2008.  After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner Richard Cortese, the bid for hot mix overlay was awarded to Wheeler Coatings, as the low bidder at $8.00 per square yard, for a total of $25,600.00  
          


  4. Agenda #2c - Circle K Farm Subdivision

    • MINUTE ORDER #280/08:   Tom Berrier with the County Engineer's Office presented for approval the final plat of Circle K Farm Subdivision, a One-Lot, 5.03 Acre Subdivision on Red Ranger Road.  After due discussion, upon motion by Commissioner Eddy Lange, second by Commissioner Richard Cortese, the Court unanimously approved this matter.
          


  5. Agenda #2d - Escarpment Subdivision

    • MINUTE ORDER #281/08:   Tom Berrier with the County Engineer's Office presented for approval the final plat of Lots 1A, 42A, 48A, and 49A, being a Re-plat of Lots 1, 42, 48, and 49 of the Escarpment Subdivision in the E.T.J. of the City of Harker Heights.  After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner John Fisher, the Court unanimously approved this matter.
          


  6. Agenda #2e - Bids for Hot Mix Overlay

    • MINUTE ORDER #282/08:  After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner Eddy Lange, the Court unanimously approved authorizing the County Engineer to advertise for bids for the hot mix overlay of the Exposition Center parking lot. 
          


  7. Agenda #3 - Personnel

    • MINUTE ORDER #283/08:    Upon motion by Commissioner John Fisher, second by Commissioner Tim Brown, the Court unanimously approved all employee status report forms, the same being attached hereto and made part of these minutes.



  8. Agenda #4 - Proclamation - General Ray and Linda Odierno Day

    • MINUTE ORDER #284/08:   County Judge Jon Burrows presented to Court a Resolution of Appreciation and Designation of July 14, 2008 as "General Raymond and Linda Odierno Day in Bell County, Texas," in recognition of the departure of the Odiernos and General Odierno's service as III Corps Commander at Fort Hood and Mrs. Odierno's service to the families of Fort Hood.  After due discussion, upon motion by Commissioner John Fisher, second by Commissioner Tim Brown, the Court unanimously approved this matter.  A copy of said Proclamation is attached hereto and made part of these minutes.



  9. Agenda #5 - Texas Association of Counties 2008 County Best Practices Award

    • MINUTE ORDER #285/08:   County Judge Jon Burrows announced that the Texas Association of Counties Leadership Foundation County Best Practices Awards Committee has chosen the Bell County "Collection Improvement Program" for a 2008 County Best Practices Award for Delivery of Service in the Financial/General Management category and recognized Phil Goodwill and Susan Weaver for their individual efforts in developing and implementing the program.  No action taken.  


  10. Agenda #6 - Bell County Census Review

    • MINUTE ORDER #286/08:   County Judge Jon Burrows reviewed the U.S. Census July 1, 2007 population estimates and projections for Bell County and the Bell County area:
              a.  Bell County - 276,975 - 4.2% increase from 2006
                   i.    12th Fastest in Texas
                   ii.    62nd Fastest in U.S.
              b.  Killeen - Temple MSA - 370,008 - 3.5% increase from 2006
                   i.    2nd Fastest in Texas
                   ii.   14th Fastest in U.S.
              c.  City of Killeen - 112,434 - 6.5% increase from 2006
                   i.    2nd Fastest in Texas
                   ii.   6th Fastest in U.S.
      No action taken.
          


  11. Agenda #7 - Capital Improvement Plan & Policy

    • MINUTE ORDER #287/08:   After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner John Fisher, the Court unanimously approved the adoption of the Capital Improvement Plan and Policy.  A copy of said Plan and Policy is attached hereto and made a part of these minutes. 
          


  12. Agenda #8 - Bell County Bond Rating

    • MINUTE ORDER #288/08:   County Judge Jon Burrows announced the upgrading of Bell County Bond Rating by Standard & Poor's to "AA" and the maintaining of "Aa3" rating from Moody's Investors Services.  No action taken.
          


  13. Agenda #9 - Limited Tax Notes

    • MINUTE ORDER #289/08:   After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner Eddy Lange, the Court unanimously approved the adoption of an Order Approving the Issuance of Bell County, Texas, Limited Tax Notes, Series 2008, in an Amount of $36,605,000; Authorizing the Levy of an Ad Valorem Tax; and Resolving Other Matters Incident and Related to the Issuance, Sale, Payment, and Delivery of Said Notes, Including the Approval and Execution of a Paying Agent/Registrar Agreement, and a Purchase Contract and the Approval and Distribution of an Official Statement; and Providing an Effective Date. A copy of said Certificate for Order is attached hereto and made part of these minutes.
          


  14. Agenda #10 - Limited Tax Refunding Bonds

    • MINUTE ORDER #290/08:   After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner Richard Cortese, the Court unanimously approved the adoption of an Order Approving the Issuance of Bell County, Texas, Limited Tax Refunding Bonds, Series 2008 in an Amount of $29,495,000; Specifying the Terms and Features of Said Bonds; Levying a Continuing Direct Annual Ad Valorem Tax for the Payment of Said Bonds; and Resolving Other Matters Incident and Related to the Issuance, Sale, Payment, and Delivery of Said Bonds, Including the Approval and Execution of a Paying Agent/Registrar Agreement, and Escrow Agreement and a Purchase Contract and the Approval and Distribution of an Official Statement; and Providing an Effective Date.  A copy of said Certificate for Order is attached hereto and made part of these minutes.
          


  15. Agenda #11 - Award of Proposals for Employee Health Insurance

    • MINUTE ORDER #291/08:   After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner John Fisher, the Court unanimously approved Scott & White to be the sole carrier with a rate guarantee for 3 years and the County contribution for the Employees of Bell County will be $347.79. 
          


  16. Agenda #12 - Facility Disaster Plan for Bell County Juvenile Services Center & Memorandums of Understanding

    • MINUTE ORDER #292/08:   Tom Kozney, Director of Juvenile Probation, presented for approval the Facility Disaster Plan for Bell County Juvenile Services Center, Memoranda of Understanding for Housing, and Memoranda of Understanding for Transportation.  After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner Eddy Lange, the Court unanimously approved this matter.  Copies of the Memoranda of Understanding are attached hereto and made part of these minutes.
          


  17. Agenda #13 - Memorandum of Understanding for Bell County Juvenile Justice Alternative Education Program (JJAEP)

    • MINUTE ORDER #293/08:   Tom Kozney, Director of Juvenile Probation, presented for approval the annual Memorandum of Understanding with certain area Independent School Districts (Killeen, Temple, Belton, Troy, Rogers, Holland, Bartlett, Salado, Academy, and Florence), Bell County Juvenile Board, and Bell County Commissioners Court regarding the operation and administration of the Bell County Juvenile Justice Alternative Education Program (JJAEP).  After due discussion, upon motion by Commissioner Eddy Lange, second by Commissioner Richard Cortese, the Court unanimously approved this matter.  A copy of the Memorandum of Understanding is attached hereto and made part of these minutes.
          


  18. Agenda #14 - Killeen ISD Memorandum of Understanding for Bell County Juvenile Justice Center

    • MINUTE ORDER #294/08:   Tom Kozney, Director of Juvenile Probation, presented for approval the annual Memorandum of Understanding with Killeen Independent School District, Bell County Juvenile, and Bell County Commissioners Court regarding the Residential educational services for juveniles detained at the Bell County Juvenile Detention Center.   After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner Eddy Lange, the Court unanimously approved this matter.  A copy of the Memorandum of Understanding is attached hereto and made part of these minutes.
          


  19. Agenda #15 - Bid for Construction of a Multi-Purpose Facility

    • MINUTE ORDER #295/08:   After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner John Fisher, the Court unanimously approved authorizing the County Auditor to advertise for bids from General Contractors for the construction of a Multi-Purpose Facility. 
          


  20. Agenda #16 - RFP #1-08 Fiber Optics

    • MINUTE ORDER #296/08:   After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner Richard Cortese, the Court unanimously approved rejecting all bids under RFP #1-08 and the re-advertising for bids regarding the construction and installation of Fiber Optic cable to the new jail and Temple CSCD building. 
          


  21. Agenda #17 - Change Orders with Stewart Builders, Inc.

    • MINUTE ORDER #297/08:   After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner Eddy Lange, the Court unanimously approved the Change Orders with Stewart Builders, Inc. for the Bell County Exposition Center in the amount of $58,145.66.  A copy of the Change Orders are attached hereto and made part of these minutes.
          


  22. Agenda #18 - Change Order Number 007 with Skanska USA Building,  Inc.

    • MINUTE ORDER #298/08:   After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner John Fisher, the Court unanimously approved Change Order Number 007 with Skanska USA Building, Inc. for the Bell County Jail addition with no change or increase in the Guaranteed Maximum Price.  A copy of the Change Order is attached hereto and made part of these minutes.
          


  23. Agenda #19 - Claims

    • MINUTE ORDER #299/08:   County Judge Jon Burrows presented the claims for review to the Court.  After proper review, upon motion by Commissioner Tim Brown, second by Commissioner Richard Cortese, the Court unanimously approved all such claims.  All according to a copy of the same being of record in the office of the County Auditor.



  24.         (The Court then went into workshop session to discuss those items on the workshop agenda with no action being
             taken on any item.)


             There being no further business, the meeting adjourned.
