AFTER proper posting of public notice, a copy of which is attached hereto, on this the 25th day of August, 2008, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #353/08:  County Judge Jon Burrows called to the Courts attention that the minutes of August 18, 2008, 9:00 a.m. regular session had been received.  After due discussion, these minutes were approved as presented.



  2. Agenda #2a - County Engineer

    • MINUTE ORDER #354/08:   County Engineer Richard Macchi presented no items for consideration.  No action taken.  
          


  3. Agenda #3 - Personnel

    • MINUTE ORDER #355/08:    Upon motion by Commissioner John Fisher, second by Commissioner Tim Brown, the Court unanimously approved all employee status report forms, the same being attached hereto and made part of these minutes.



  4. Agenda #4 - Order Restricting Outdoor Burning

    • MINUTE ORDER #356/08:   The Court received a report from Fire Marshall Steve Casey, a copy of which is attached and made part of these minutes, to consider continuing, modifying, or terminating an Order Restricting Outdoor Burning.  After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner Eddy Lange, the Court unanimously approved to reinstate the Order dated July 31, 2008, effective at sunset, Monday, August 25, 2008, for thirty (30) days.  A copy of said Order is attached hereto and made part of these minutes.



  5. Agenda #5 - Shaken Baby Syndrome and Child Safety Awareness Month in Bell County

    • MINUTE ORDER #357/08:    County Judge Jon Burrows presented for approval a Proclamation designating September as Shaken Baby Syndrome and Child Safety Awareness Month in Bell County.  Teresa Young accepted the Proclamation on behalf of the Exchange Club of Killeen, the One Spirit Exchange Club of Killeen and the Temple Exchange Club.  After due discussion, upon motion by Commissioner John Fisher, second by Commissioner Tim Brown, the Court unanimously approved this matter.  A copy of said Proclamation is attached hereto and made part of these minutes.



  6. Agenda #6 - Order for Special Election

    • MINUTE ORDER #358/08:    County Clerk Shelley Coston presented for approval an Order for Special Election to be held November 4, 2008, in Bell County, Texas for the purpose of electing State Representative District 55, Unexpired Term.  After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner Richard Cortese, the Court unanimously approved this Order, a copy of which is attached hereto and made part of these minutes.



  7. Agenda #7 - Order for Municipal Election

    • MINUTE ORDER #359/08:    County Clerk Shelley Coston presented for approval an Order of Municipal Election to vote for School Board Trustee in the Moody Independent School District to be held November 4, 2008.  After due discussion, upon motion by Commissioner Eddy Lange, second by Commissioner Richard Cortese, the Court unanimously approved this Order, a copy of which is attached hereto and made part of these minutes.



  8. Agenda #8 - Order for General Election

    • MINUTE ORDER #360/08:    County Clerk Shelley Coston presented for approval an Order of General Election to be held on November 4, 2008, in Bell County, Texas for the purpose of electing County and Precinct Officers as required by Article XVI, Section 65 of the Texas Constitution.  After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner Eddy Lange, the Court unanimously approved this Order, a copy of which is attached hereto and made part of these minutes.



  9. Agenda #9 - County Indigent Health Care Program Report

    • MINUTE ORDER #361/08:    Rita Kelley, Director of Bell County Indigent Health Services presented a report on the County Indigent Health Care Program for the period of September 2007 through August 2008.  A copy of said report is attached hereto and made part of these minutes.  No action taken.



  10. Agenda #10 - CIHCP Services for State of Texas FY 2009

    • MINUTE ORDER #362/08:    Rita Kelley, Director of Bell County Indigent Health Services presented for approval the following inclusions of Optional CIHCP services during the State of Texas FY 2009:  1) Non-emergency medical transportation; 2) Medical case management; and 3) Cost effective alternatives/procedures.  After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner Richard Cortese, the Court unanimously approved this matter.



  11. Agenda #11 - Continued Administration of CIHCP

    • MINUTE ORDER #363/08:    After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner Tim Brown, the Court unanimously approved the continued administration of the CIHCP according to policies described in the County Indigent Health Care Handbook of the Texas Department of State Health Care Services.



  12. Agenda #12 - FY 09/10 State Case Registry and Local Customer Service Contract Cooperative Agreement

    • MINUTE ORDER #364/08:    District Clerk Shelia Norman presented for approval the FY 09/10 State Case Registry and Local Customer Service Contract Cooperative Agreement between The Office of the Attorney General of the State of Texas and Bell County, Texas, for the collection of child support.  This contract is renewed bi-annually.  After due discussion, upon motion by Commissioner Eddy Lange, second by Commissioner Richard Cortese, the Court unanimously approved this matter.



  13. Agenda #13 - Advertising for Request for Qualifications for Architects and Engineers

    • MINUTE ORDER #365/08:    After due discussion, the Court took no action on authorizing the County Auditor to advertise for Request for Qualifications for Architects and Engineers.



  14. Agenda #14 - Approval of the FY 2009 Budget for Bell County

    • MINUTE ORDER #366/08:    County Judge Jon Burrows presented for approval the FY 2009 Budget for Bell County.  After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner John Fisher, the Court unanimously approved this matter.



  15. Agenda #15 - Approval of the FY 2009 Bell County and Bell County Road District Tax Rates

    • MINUTE ORDER #367/08:    After notice and hearing the following motion was offered by Commissioner Tim Brown, and seconded by Commissioner John Fisher:
         
      "I move that property taxes be increased by the adoption of a tax rate per $100 valuation for Bell County of $0.3779 (which is comprised of
          $0.2835 for Maintenance and Operations and $0.0944 for Debt Service) and Bell County Road District of $0.0295 for a total tax rate for the
          2008-2009 Fiscal Year of $0.4074."
          "THIS RATE WILL RAISE MORE TAXES FOR MAINTENANCE AND OPERATIONS THAN LAST YEAR'S TAX RATE.  THE TAX
          RATE WILL RAISE TAXES FOR MAINTENANCE AND OPERATIONS ON A $100,000 HOME BY APPROXIMATELY $8.00."
      After due discussion, the Court unanimously approved this matter.



  16. Agenda #16 - Ratification Under Section 111.039(c) of the Local Government Code

    • MINUTE ORDER #368/08:    After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner John Fisher, the Court pursuant to Section 111.039(c) of the Local Government Code unanimously ratified the property tax increase reflected in the budget.



  17. Agenda #17 - Claims

    • MINUTE ORDER #369/08:   County Judge Jon Burrows presented the claims for review to the Court.  After proper review, upon motion by Commissioner Tim Brown, second by Commissioner Richard Cortese, the Court unanimously approved all such claims.  All according to a copy of the same being of record in the office of the County Auditor.



  18.         (The Court then went into workshop session to discuss those items on the workshop agenda with no action being
             taken on any item.)


             There being no further business, the meeting adjourned.
