AFTER proper posting of public notice, a copy of which is attached hereto, on this the 3rd day of November, 2008, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #475/08:  County Judge Jon Burrows called to the Courts attention that the minutes of October 27, 2008, 9:00 a.m. regular session had been received.  After due discussion, these minutes were approved as presented.



  2. Agenda #2a - County Engineer

    • MINUTE ORDER #476/08:   County Engineer Richard Macchi presented for approval awarding of the bids for the annual purchase of crushed limestone base, aggregate, culverts, and reinforcing steel. 
      After due discussion, upon motion by Commissioner Eddy Lange, second by Commissioner Richard Cortese, the Court unanimously approved awarding the bid for reinforcing steel to CMC Alamo Steel, Waco, in the amount of $60.00 per one-hundred pounds. 
      After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner John Fisher, the Court unanimously approved awarding the bid for crushed limestone base to all who submitted a bid.
      After due discussion, upon motion by Commissioner John Fisher, second by Commissioner Eddy Lange, the Court unanimously approved awarding the bid for Grade 4 Aggregate to Killeen Crushed Stone in the amount of $14 per ton; and Grade 5 Aggregate to TXI in the amount of $20 per cy. 
      After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner Eddy Lange, the Court unanimously approved awarding the bid for Culverts to Wilson Culverts, the low bidder, in the amount of $109,642.
          


  3. Agenda #3 - Personnel

    • MINUTE ORDER #477/08:    Upon motion by Commissioner John Fisher, second by Commissioner Richard Cortese, the Court unanimously approved all employee status report forms, the same being attached hereto and made part of these minutes.



  4. Agenda #4 - Voting Locations for General Election

    • MINUTE ORDER #478/08:    County Clerk Shelley Coston re-announced Voting locations and hours for the November 4, 2008 General Election:

      A.  Voting Locations are posted on the Bell County Web Site at www.bellcountytx.com.
      B.  Election Day Voting (Tuesday, November 4, 2008) - 7:00 a.m. to 7:00 p.m. at the voter's precinct polling location.



  5. Agenda #5 - Order Restricting Outdoor Burning

    • MINUTE ORDER #479/08:    County Judge Jon Burrows presented for approval the matter of the termination, modification, or continuation of the Order Restricting Outdoor Burning - Burn Ban.  No action taken by the Court and the Order remains in effect until November 19, 2008.



  6. Agenda #6 - City of Temple Home Repair Program

    • MINUTE ORDER #480/08:    After due discussion, the Court considered the matter of approving an Agreement with the City of Temple for the Bell County HELP Center to administer the City of Temple Home Repair Program.  The Court took no action on this matter pending further information.



  7. Agenda #7 - Excellence in Construction Award of Merit

    • MINUTE ORDER #481/08:    County Judge Jon Burrows recognized Mark Hibner with Skanska USA Building, Inc. who received the 2008 Excellence in Construction Award of Merit from Associated Builders and Contractors, Inc. South Texas Chapter, for the Bell County Jail Project.  No action taken.



  8. Agenda #8 - Insurance Agreement with Extraco Insurance

    • MINUTE ORDER #482/08:    After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner Eddy Lange, the Court unanimously approved the option to renew the Insurance Agreement with Extraco Insurance for another year as permitted in the original RFP, where the agreement was initiated September 1, 2006, for one year with the option to renew yearly for four more years.



  9. Agenda #9 - Temple Mortuary Agreement

    • MINUTE ORDER #483/08:    After due discussion, upon motion by Commissioner Eddy Lange, second by Commissioner Richard Cortese, the Court unanimously approved the option to renew the Agreement with Temple Mortuary for the Transporting of Bodies for Autopsies as allowed in the original bid and agreement, dated November 1, 2006, awarded for one year with the option to renew for up to two more years.



  10. Agenda #10 - Bell County Jail Project - Substantial Completion

    • MINUTE ORDER #484/08:    Don Olsen, Wiginton Hooker Jeffry, P.C., Architects, presented for acceptance the Substantial Completion on the new Bell County Jail Project from Skanska USA Building, Inc.  After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner John Fisher, the Court unanimously approved this matter, a copy of which is attached hereto and made part of these minutes.



  11. Agenda #11 - ESESIS Environmental Corp.

    • MINUTE ORDER #485/08:    After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner John Fisher, the Court unanimously approved renewing the agreement with ESESIS Environmental Corp. initiated in 2005 and expiring in 2008 resulting from an RFQ process with the fees set for three years at the same rate, and then with an option to renew for two more years at a fifteen percent fee increase.  A copy of said agreement is attached hereto and made part of these minutes.



  12. Agenda #12 - Diamond Pharmacy Services Agreement

    • MINUTE ORDER #486/08:    After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner Eddy Lange, the Court unanimously approved renewing the agreement with Diamond Pharmacy Services to continue on a month-to-month basis.



  13. Agenda #13 - Change Order Number 003 - Bell County Expo Center

    • MINUTE ORDER #487/08:    County Judge Jon Burrows presented for approval Change Order Number 003  with Stewart Builders in the amount of $19,603.52 for renovations to the Bell County Expo Center.  After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner John Fisher, the Court unanimously approved this matter, a copy of which is attached hereto and made part of these minutes.


  14. Agenda #14 - Management Agreement with Bell County Expo, Incorporated

    • MINUTE ORDER #488/08:    County Judge Jon Burrows presented for approval the renewal of Management Agreement with Bell County Expo Incorporated to manage the Bell County Expo Center, with effective dates of October 1, 2007 through September 30, 2012.  After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner Richard Cortese, the Court unanimously approved the matter, a copy of which is attached hereto and made part of these minutes.



  15. Agenda #15 - Construction Manager at Risk for County Courts at Law Building Project

    • MINUTE ORDER #489/08:    After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner John Fisher, the Court unanimously approved Skanska USA Building, Inc. as Construction Manager at Risk for the County Courts at Law Building Project and authorized the architects to enter negotiations with Skanska USA Building, Inc.



  16. Agenda #16 - Change Order Proposal #89

    • MINUTE ORDER #490/08:    The Court took no action regarding approval of Change Order Proposal Number 89 with Skanska USA Building, Inc., in the amount of $2,273.00 for intercom pedestal relocation at the Bell County Jail Project.



  17. Agenda #17 - Claims

    • MINUTE ORDER #491/08:   County Judge Jon Burrows presented the claims for review to the Court.  After proper review, upon motion by Commissioner Tim Brown, second by Commissioner Richard Cortese, the Court unanimously approved all such claims.  All according to a copy of the same being of record in the office of the County Auditor.



  18.         (The Court then went into workshop session to discuss those items on the workshop agenda with no action being
             taken on any item.)


             There being no further business, the meeting adjourned.
