AFTER proper posting of public notice, a copy of which is attached hereto, on this the 05th day of October, 2009, the County Commissioners Court of Bell County, Texas, met in the Commissioners' Courtroom in Belton, Texas, in regular session with the following members of said Court present, to-wit:

  1. Agenda #1 - Minutes

    • MINUTE ORDER #406/09:  County Judge Jon Burrows called to the Courts attention that the minutes of September 28, 2009 regular session had been received.  After due discussion, these minutes were approved as presented.



  2. Agenda #2a - County Engineer

    • MINUTE ORDER #407/09:   County Judge Jon Burrows opened a public hearing at 9:07 a.m. for comments regarding installation of a traffic control device, to-wit:  A 35 MPH speed limit on a portion of Auction Barn Road.  Richard (Dan) Savage, 3167 Auction Barn Road, Belton, Texas, opposed the installation and requested keeping the speed limit at 45 MPH.  Sam Listi, City Manager, City of Belton, gave comments in favor of the 35 MPH speed limit.  There being no other comments, the public hearing was closed at 9:14 a.m.  After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner Tim Brown, the Court unanimously approved the installation of a 35 MPH speed limit on a portion of Auction Barn Road.  
           
          

  3. Agenda #2b - County Engineer

    • MINUTE ORDER #408/09:   County Judge Bryan Neaves presented for approval the option of exercising the County's Buy-Back Option with Holt Caterpillar for the purchase and sale (trade-in) of four 140H Motor Graders.  After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner John Fisher, the Court unanimously approved this matter. 
           
          

  4. Agenda #2c - County Engineer

    • MINUTE ORDER #409/09:   After due discussion, upon motion by Commissioner Eddy Lange, second by Commissioner Richard Cortese, the Court unanimously approved authorizing the County Engineer to advertise for bids for a 2,000 gallon water tank.  
           
          

  5. Agenda #3 - Personnel

    • MINUTE ORDER #410/09:    Upon motion by Commissioner John Fisher, second by Commissioner Eddy Lange, the Court unanimously approved all employee status report forms with approved budget amendment, the same being attached hereto and made a part of these minutes.
          


  6. Agenda #4 - Domestic Violence Awareness Month

    • MINUTE ORDER #411/09:    After due discussion, upon motion by Commissioner John Fisher, second by Commissioner Richard Cortese, the Court unanimously approved a Proclamation declaring October as Domestic Violence Awareness Month in Bell County, Texas.  A copy of said Proclamation is attached hereto and made a part of these minutes.  
          


  7. Agenda #5 - National Fire Prevention Month

    • MINUTE ORDER #412/09:    After due discussion, upon motion by Commissioner Eddy Lange, second by Commissioner Richard Cortese, the Court unanimously approved a Proclamation declaring October as National Fire Prevention Month in Bell County, Texas.    
          


  8. Agenda #6 - National 4-H Week in Bell County, Texas

    • MINUTE ORDER #413/09:    County Judge Jon Burrows presented a Proclamation declaring October 4-10, 2009, as National 4-H Week in Bell County, Texas to Micah Holcomb, 4-H Director for Bell County with the Texas AgriLife Extension Office who recognized local 4-H Ambassadors Peter Fasolino and Taylor Marburger.  After due discussion, upon motion by Commissioner Eddy Lange, second by Commissioner Tim Brown, the Court unanimously approved this Proclamation, a copy of which is attached hereto and made part of these minutes.     
          


  9. Agenda #7 - County Auction Report

    • MINUTE ORDER #414/09:    Russell Williams, Assistant Auditor, presented for approval on the County Auction held September 22, 2009.  After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner Tim Brown, the Court unanimously approved this report, a copy of which is attached hereto and made part of these minutes.     
          


  10. Agenda #8 - Tire Collection

    • MINUTE ORDER #415/09:    After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner John Fisher, the Court unanimously approved a report on the Tire Collection held September 24-26, 2009.  A copy of said report is attached hereto and made part of these minutes.     
          


  11. Agenda #9 - Notification of Intent for Energy Efficiency and Conservation Block Grant

    • MINUTE ORDER #416/09:    County Judge Jon Burrows presented for approval submission of Notification of Intent to the Texas Comptroller of Public Accounts to accept the Energy Efficiency and Conservation Block Grant (EECBG) allocation under the American Recovery and Reinvestment Act (ARRA) in the approximate amount of no less than $120,000.00.  After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner Eddy Lange, the Court unanimously approved this matter.     
          


  12. Agenda #10 - Energy Efficiency and Conservation Block Grant Resolution

    • MINUTE ORDER #417/09:    After due discussion, upon motion by Commissioner Tim Brown, second by Commissioner Eddy Lange, the Court unanimously approved a Resolution to accept Bell County's allocation of the Energy Efficiency and Conservation Block Grant (EECBG) and to also accept additional funds that may become available at a later date, to pursue all EECBG funding made available through the American Recovery and Reinvestment Act (ARRA) allocated by the State Energy Conservation Office and to continue Bell County's commitment toward energy efficiency.    
          


  13. Agenda #11 - Change Order Number 002 - Bell County Central Jail Renovation

    • MINUTE ORDER #418/09:    After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner Tim Brown, the Court unanimously approved Change Order Number 002 between Bell County and Skanska USA Building, Inc. on the Bell County Central Jail Renovation for upgrade of detention slider doors and controls.  (In order to proceed in sequence, this project will have a number of Change Orders as pricing on different segments are set.  While the interim GMP's will be increased by the addition of each segment, the final GMP will not exceed the estimated total project cost.)  A copy of said Change Order is attached hereto and made part of these minutes.     
          


  14. Agenda #12 - Bell County Public Health District

    • MINUTE ORDER #419/09:    County Judge Jon Burrows presented for approval an Agreement with Bell County Public Health District to provide funding in the amount of $143,080.00 for the Bell County Public Health District Fiscal Year 2010, beginning September 1, 2009, and ending August 31, 2010.  After due discussion, upon motion by Commissioner Richard Cortese, second by Commissioner John Fisher, the Court unanimously approved this matter.     
          


  15. Agenda #13 - Agreement for TexasOnline Services

    • MINUTE ORDER #420/09:    District Clerk Shelia Norman presented for approval an updated Customer Agreement between the Texas Department of Information Resources (DIR), Texas NICUSA, LLC (Vendor) and Bell County (Customer) for TexasOnline Services.  After due discussion, upon motion by Commissioner Eddy Lange, second by Commissioner Tim Brown, the Court unanimously approved this matter.     
          


  16. Agenda #14 - Claims

    • MINUTE ORDER #421/09:   County Judge Jon Burrows presented the claims for review to the Court.  After proper review, upon motion by Commissioner Tim Brown, second by Commissioner Richard Cortese, the Court unanimously approved all such claims.  All according to a copy of the same being of record in the office of the County Auditor.


             (The Court then went into workshop session to discuss those items on the workshop agenda with no action being taken on any item.)


             There being no further business, the meeting adjourned.
